Authorizing the City to execute a quit claim deed to release any rights it may have in a public alley created in a 1929 deed between private parties affecting the property at 2383 University Avenue.
Body
WHEREAS, on November 26, 1929 Martin Moffat conveyed by warranty deed to Russell Moffat an undivided one-half interest in the property now located at 2383 University Avenue, as found in Document Number 981155 in Book 1064, Page 127, Ramsey County, Minnesota (the "Property"); and
WHEREAS, said deed excepted and reserved over a portion of the Property a 20-foot-wide public alley easement; and
WHEREAS, the City of Saint Paul's Department of Public Works has found no record of the City establishing said public alley easement or ever constructing an alley within the Property, and
WHEREAS, U.S. Bank (the "Property Owner") is now requesting that the City quitclaim any interest it may have in said public alley easement; now, therefore, be it
RESOLVED, that the City Council does hereby authorize the proper city officials, via quit claim deed to the Property Owner, to terminate, release and extinguish any public reservation, easement or alley right-of-way that may exist in the Property, said deed to be in a form and content substantially as set forth in Exhibit A attached hereto.
