Purpose of Appeal: This appeal is on behalf of the tenant at this property. Ms. Marincell is requesting to be accommodated with more time to correct the deficiencies listed in the inspection report with the help of Housecalls and other disability services.

WHEREAS, in the matter of Appeal of Laura Jelinek, Southern Minnesota Regional Legal Services, representing Debra Marincell to a Revocation of Fire Certificate of Occupancy and Order to Vacate at 862 ATLANTIC STREET, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council 1) grant an extension to September 30, 2019 to reduce the volume of materials in the house by 50% (75% reduction in clutter) and remove all obstructions from egress routes including windows, doors, hallways and stairs; 2) if this work completed, grant a variance for period of tenancy for the two bedrooms to have 2 people sleeping in them; and 3) if this work is not completed, deny variance in number of bedroom occupants; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
