Pertaining to Utility Relocation Agreement No. 02886 with the State of Minnesota providing for reimbursement of Board costs to relocate a water main at T.H. 5 Bridge No. 9300 at Shepard Road in Saint Paul.

WHEREAS, the State of Minnesota, acting by and through its Commissioner of Transportation (the "State") intends to let a contract for State Project No. 6201-86 for the reconstruction of Trunk Highway 5 from Hennepin-Ramsey County line to just north of Edgcumbe Road in the city of Saint Paul; and
WHEREAS, the Board of Water Commissioners of the City of Saint Paul (the "Board") owns and operates certain water facilities presently located within the limits of said project; and
WHEREAS, the State has determined that relocation of Board facilities is necessitated by the construction of said project, and that Minnesota Statutes provide for this relocation work to be accomplished as part of a state highway construction contract; and
WHEREAS, the State prepared Agreement No. 02886 to provide for the reimbursement of Board costs related to the relocation of the Board water facilities at Shepard Road, at an estimated cost of $24,037.81, with final amount to be determined by actual costs; and
WHEREAS, said Agreement has been reviewed and approved by the assistant city attorney; now, therefore, be it
RESOLVED, that Agreement No. 02886 between the Board of Water Commissioners of the City of Saint Paul and the State of Minnesota pertaining to reimbursement of Board costs related to relocation of certain Board water facilities within State Project No. 6201-86 Trunk Highway 5 is hereby approved, and that the proper officers are hereby authorized and directed to execute said agreement on behalf of the Board.
