Accepting a dedication of easement for public sewer purposes from Independent School District No. 625 as part of the improvement and expansion of the American Indian Magnet School site.

WHEREAS, over the years the City of Saint Paul Department of Public Works (“City”) has installed and improved sewer facilities in the area bounded by Third Street, Earl Street and Fremont Avenue to benefit the American Indian Magnet School site at 516 Earl Street ("School Property"), which is owned by Independent School District No. 625 ("District"); and
WHEREAS, said sewer facilities were recently improved, installed and expanded, and the City is in need of a permanent easement for public sewer purposes within portions of the School Property; and
WHEREAS, the City has secured a Dedication of Easement for Public Sewer Purposes ("Easement") from the District, a copy of which is attached hereto as Exhibit A; and
WHEREAS, staff from the City's Public Works Sewer Division and Financial Services Real Estate Section have reviewed the Easement and recommend acceptance by the City Council; now, therefore, be it
RESOLVED, that the Mayor and Council of the City of Saint Paul do hereby accept the Easement as set forth in Exhibit A, and authorize and direct the proper city officials to record same with the Ramsey County Recorder's Office and/or Registrar of Titles.
