Denying request for a stay of enforcement of Council File RLH RR 17-46 ordering the razing or removal of the structures at 1060 AVON STREET within 15 days after the February 13, 2018 City Council Public Hearing.
Body
WHEREAS, City Council File RLH RR 17-46 ordered the razing and the demolition of the structure of 1060 Avon Street within 15 days after the February 13, 2018 City Council Public Hearing; and
WHEREAS, Council President Amy Brendmoen referred the matter back to Legislative Hearing to review this case again and to consider the possible grant of a stay of enforcement; and
WHEREAS, the Legislative Hearing Officer conducted hearing on March 13, 2018 to review this request; and
WHEREAS, the Legislative Hearing Officer indicated that the following conditions be met:
1. secure a code compliance inspection report (although application had been made and inspections were conducted, it was not complete due to excessive combustible materials);
2. provide a work plan or sworn construction statement with timelines and contractor bids for completion of the rehabilitation of the building;
3. provide evidence of financial wherewithal to complete the rehabilitation of the property; and
4. provide for the exterior maintenance of the property; and
WHEREAS, the Legislative Hearing Officer recommends the Council deny the request for a stay of enforcement of Council File RLH RR 17-46 ordering the razing and the demolition of the structures at 1060 Avon Street within 15 days after the March 28, 2018 City Council Public Hearing based on the failure to meet the listed above conditions; Now, therefore, be it
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter, denying a stay of enforcement of Council File RLH RR 17-46 ordering the razing and the demolition of the structures at 1060 Avon Street within 15 days after the April 4, 2018 City Council Public Hearing; and be it
