Approving a request by WRA 1276, L.L.C. to release a sewer easement within previously vacated Wakefield Avenue.
Body
WHEREAS, a request has been received from WRA 1276, LLC, owner of the Wilson Ridge Apartments at 1276 Wilson Avenue in St. Paul, for the release of a 30-foot wide sewer easement centered on the existing sewer facility within previously vacated Wakefield Avenue (RES PH 14-160), legally described as:
All that part of Wakefield Avenue from the extended west line of Lot 19, Block 2, Lindley Heights to the extended west line of Lot 17, Block 2, Lindley Heights, Ramsey County;
And as defined in Council File No. RES PH 14-160 and filed of record with Ramsey County as Document No. T02509553;
(the “Easement Area”) and;
WHEREAS, the Department of Public Works (“Public Works”), on behalf of the City of Saint Paul (“City”), has agreed to transfer ownership of the sewer pipe within the Easement Area to WRA 1276 L.L.C. per agreement attached as Exhibit A; and
WHEREAS, upon execution of the transfer agreement Public Works will sign a Certificate of Intended Non-Use to release the City’s interest in the sewer easement, attached as Exhibit B; now, therefore be it
RESOLVED, that with the accompanying Certificate of Intended Non-Use, filed voluntarily on behalf of Public Works and made a part hereof by this reference, the City waives all rights to said sewer easement within the Easement Area; and be it further
RESOLVED, that upon passage of this resolution, execution of the sewer conveyance agreement and the City's receipt of a $300.00 administrative processing fee, the proper City officials are hereby authorized to record a certified copy of this resolution in the office of the Ramsey County Recorder and/or Registrar of Titles.
