Title

Authorizing the City to enter into a Cooperative Agreement with the Minnesota Department of Transportation (the “State”) for construction of the Fish Hatchery Trail on Truck Highway No. 61 Right-of-Way.

Body

WHEREAS, pursuant to the provisions of Minnesota Statutes Section 471.59, two or more governmental units, by agreement entered into through action of their governing bodies, are authorized to enter into agreements to exercise jointly or cooperatively governmental powers common to each and to permit one governmental entity to perform services or functions for another governmental unit; and

WHEREAS, the City and the State (the “Jurisdictions”) are governmental units as defined in Minnesota Statutes Section 471.59; and

WHEREAS, the State owns and/or administers Right-of-Way along Trunk Highway No. 61 in Ramsey County; and

WHEREAS, the City wishes to perform trail reconstruction and other associated construction upon, along, and adjacent to the Battle Creek Park entrance at Trunk Highway No. 61 to the intersection of Warner Road according to City-prepared plans, specifications, and special provisions designated by the City and the State as State Project No. 6220-95 (TH 61=104) (Project); and

WHEREAS, the City is committed to the establishment of a public trail to enhance and promote Saint Paul’s identity as a livable and creative city and a desirable place to live, work, and visit; and

WHEREAS, the City wishes to enter into a Cooperative Agreement with the State and to accept the requirements of said agreement to proceed with the Project, which includes a requirement that the City indemnify the State; and

WHEREAS, the City Council finds that the cooperation between the City and the State for public trail promotes the City’s commitment as an important asset of the City; now, therefore, be it

RESOLVED, that the Saint Paul City Council hereby authorizes the appropriate City officials to enter into the attached Cooperative Agreement ...
