Title
Amending Chapter 409 of the Legislative Code pertaining to the distance restriction between liquor license locations and to reduce the location radius for off-sale wine only license locations.

WHEREAS, the City of Saint Paul has imposed, by ordinance, certain distance requirements between liquor license locations within the City; and
WHEREAS, these distance requirements are intended to protect the residents and businesses near a liquor location from the traffic volume, nuisance behavior and other negative impacts that may occur if additional off-sale liquor licenses were permitted within in a smaller radius; and
WHEREAS, the City wishes to continue to support the opening and continued vitality of all neighborhood businesses, and to increase opportunities for more, especially during difficult events and economic times that cause so much devastation to our local businesses; and
WHEREAS, boutique wine businesses, which hold only an off-sale wine only license, could be an asset to a neighborhood; and
WHEREAS, Saint Paul Legislative Code Chapter 409 currently requires a half- mile radius between all types of off-sale liquor locations, and the City would like to reduce the radius between liquor locations to 300 feet one-quarter mile, only for off-sale wine-only licenses.
NOW, THEREFORE, BE IT RESOLVED, that the Council of the City of Saint Paul does hereby ordain:
SECTION 1
That Section 409.06, Licensing requirements, of the Saint Paul City Legislative Code is hereby amended to read as follows:
Sec. 409.06. - Licensing requirements.
(a) Application. Any person desiring a license to sell intoxicating liquor shall make his verified application in writing upon a form approved by the liquor control commissioner of the state and shall file the same with the inspector.
