Approving adverse action against the Taxicab Driver license application submitted by David M. Arth.

WHEREAS, the Taxicab Driver license application submitted by David M. Arth (License ID# 19980008852) for the City of Saint Paul was the subject of a Notice of Intent to Deny License dated January 20, 2016, stating the applicant was convicted on November 5, 2015 of fourteen (14) counts of Felony Possession of Pornographic Work-Computer Disk/Electronic/Magnetic/Optical Image with/Porn in violation of Minn. Stat. §617.247.4(a) in Ramsey County District Court; and
WHEREAS, the applicant was then placed on Supervised Release for a period of five (5) years from January 15, 2016 to January 15, 2021; and
WHEREAS, as a result of these convictions, per Saint Paul Legislative Code § 310.06 (b) (6) (c), the licensing office recommended license denial; and
WHEREAS, the applicant did not respond to the Notice of Intent to Deny License to withdraw his license application or request a public or administrative hearing; and
WHEREAS, the Notice of Intent to Deny License stated that if the applicant failed to withdraw his license application or request a public or administrative hearing by February 1, 2016, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Taxicab Driver license application submitted by David M. Arth is hereby denied.
