Authorizing the Department of Parks and Recreation to enter into a Power of Attorney agreement with Dimerco Customs Brokerage Services Company Ltd., and to provide indemnification, for services to bring the Xiang Jiang Pavilion, West Entrance Gate, and Hmong Heritage Wall into the United States for installation at Phalen Regional Park.

WHEREAS, the Department of Parks and Recreation is creating a St. Paul - Changsha,China Friendship Garden in Phalen Park and the project includes the Xiang Jiang Pavilion, a replica of Changsha’s famous Aiwan Pavilion, the West Entrance Gate, and the Hmong Embroidery wall sculpture, all sister-city gifts from Changsha, China; and
WHEREAS, the Department needs the assistance of Dimerco Customs Brokerage Services Company Ltd. to act on its behalf as a customs agent to facilitate the customs process for shipping and acceptance of these items; and
WHEREAS, Dimerco Customs Brokerage Services Company Ltd. requires that the City enters into a Power of Attorney agreement, which includes a promise of indemnification, for agent services; and
WHEREAS, the St. Paul - Changsha, China Friendship Garden project will positively impact Phalen Regional Park and the City of Saint Paul with the installation of a replica of Changsha’s famous Xiang Jiang Pavilion, West Entrance Gate, and a symbolic Hmong sculpture; and
WHEREAS, the Saint Paul City Council finds that the promise of indemnification in the agreement with Dimerco will ensure the orderly and proper arrival of the Sister City gifts and has a public purpose; now, therefore, be it
RESOLVED, that appropriate city authorities are hereby authorized to enter into the attached Power of Attorney agreement with Dimerco Customs Brokerage Services Company Ltd, which includes a promise of indemnification.
