Memorializing City Council action taken October 20, 2010, approving adverse action against all licenses held by Axmed X. Cali, d/b/a Lounge 280, 2418 University Avenue.

Body
WHEREAS, Axmed S. Cali d/b/a Lounge 280 (License ID # 20090003176) (hereinafter licensee) located at 2418 University Avenue West in Saint Paul received an Notice of Violation dated September 23, 2010; and

WHEREAS, the Notice alleged two violations on September 11 of 2010: 1) violation of license condition # 3 - failing to monitor the sidewalk and parking lot, and 2) violation of license condition # 6 - being open after 2:00 a.m. The Notice also alleged two violations on September 17, 2010; 1) violation of license condition # 5 - audible music on the exterior of the establishment, and 2) violation of license condition # 2 - failing to verify the age of all patrons with government issued identification; and

WHEREAS, licensee denied the allegations and requested a hearing before an Administrative Law Judge; and

WHEREAS, a hearing was scheduled before an Administrative Law Judge on November 3, 2010, at which each party was represented by Counsel; and

WHEREAS, prior to the hearing, licensee decided to admit the violations; and

WHEREAS, the Department of Safety and Inspections agreed to recommend the following penalty for these violations which constitute an appearance before the Council: suspension of all licenses for a period of ten days and a fine of $2,000.00. The license suspension shall be served concurrently with the suspension for failure to pay a fine that began on October 28, 2010. Licensee shall pay $1,000 no later than December 3, 2010. The remaining $1,000 shall be suspended for one year on the condition that the licensee have no license violations of any kind; now therefore be it

RESOLVED, that the Council hereby finds the licensee has committed a license violation; and be it
