Accepting right-of-way easements to dedicate a new public street in conjunction with the housing development by Buhl Investors at 102 Water Street and 150 Water Street on the City's West Side.
Body
WHEREAS, Buhl Investors ("Developer") owns property at 102 Water Street West, 150 Water Street West and 115 Plato Boulevard West, which is being developed as apartment housing; and
WHEREAS, as part of the site plan approval process for the proposed improvements, the City of Saint Paul ("City") is requiring the dedication of public right-of-way easements (the "Easements") over three properties owned by the Developer - new Bidwell Street - within the same general alignment as former Bidwell Street, which had been vacated years ago; and
WHEREAS, the Developer has agreed to dedicate the Easements and is now requesting that the City accept the Easements, as provided in Exhibits A, B and C attached hereto; and
WHEREAS, the City and the City Attorney's Office have reviewed and approved the Easements as attached; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby accept the Easements, in a form and content substantially as set forth in Exhibits A, B and C, attached hereto; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt from the Developer of a $300.00 administrative processing fee, the City is directed to record the original of same with the Ramsey County Recorder's Office and/or Registrar of Titles.
