Pertaining to an Amendment No. 1 to Agreement for Sale and Purchase of Real Property with Mee K. Vangsoua and Michael Thao.

WHEREAS, the Board of Water Commissioners of the City of Saint Paul (“Board”) entered into that certain Agreement for Sale and Purchase of Real Property (“PA”) with Mee K. Vangsoua and Michael Thao (the “Sellers”) for the purchase of property located at1845 Beaumont Street North in the city of Maplewood (“Property”) to minimize costs related to its McCarron’s Water Treatment Plant Improvement Project (“Project”); and
WHEREAS, the closing for the purchase of the property occurred December 31, 2021; and
WHEREAS, the PA included a Holdover and Possession section giving the sellers the right to remain in and to occupy the Property including the right to peacefully and quietly have, hold, and enjoy the property until June 1, 2022; and
WHEREAS, The Board now has a need to utilize a portion of the property to build a construction road for purposes related to the Project and has requested from the Sellers the right to occupy the back and side yards of the Property; and
WHEREAS, the Sellers are willing to grant such rights in exchange for continued occupancy of the remaining portions of the Property until August 1, 2022; and
WHEREAS, City of Saint Paul Real Estate Division has drafted an Amendment No. 1 to Agreement for Sale and Purchase of Real Property, which reflects these exchanges of rights; and
WHEREAS, staff has reviewed and approved said amendment and the assistant city attorney has approved said amendment as to form; now, therefore, be it
RESOLVED, that Amendment No. 1 to Agreement for Sale and Purchase of Real Property between the Board of Water Commissioners and Mee K. Vangsoua and Michael Thao is hereby approved and that the proper officers are hereby authorized and directed to execute said Amendment on behalf of the Board.
