Approving adverse action against the Second Dealer license application submitted by John E. Norris, d/b/a EJ Liquidation at 323 Larch Street.

WHEREAS, adverse action was taken against the Second Dealer license application submitted by John E. Norris d/b/a EJ Liquidation (License ID #20120005160) for the premises located at 323 Larch Street in Saint Paul, by Notice of Intent to Deny License dated February 22, 2013, alleging licensee was operating a second hand dealer business without obtaining the appropriate license; and
WHEREAS, the licensee had not submitted to DSI a floor plan and a proposal of how he was going to accommodate the building code requirements for heat/ventilation, potable water supply and a restroom in order to continue to occupy the building; and
WHEREAS, the licensee was cited by a DSI Inspector, during inspections on December 31, 2012; February 1, 2013 and February 7, 2013 for storing and sorting materials outside the building in violation of Section 66.541(b) of the Zoning Code; and
WHEREAS, the licensee did not respond to the Notice of Deny License to obtain a Second Hand Dealer license, clean up the exterior storage, show compliance with building code requirements, request a hearing or withdraw his license application; and
WHEREAS, the Notice of Intent to Deny License stated if the licensee failed to obtain a Second Hand Dealer license, clean up the exterior storage, show compliance with building code requirements, request a hearing or withdraw his license application by March 4, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Second Dealer license application submitted by John E. Norris d/b/a EJ Liquidation is hereby denied.
