Requesting approval of a Driveway Access Easement and Maintenance Agreement between the City and Rail Transfer, Inc. pertaining to city-owned land at 677 and 689 Pierce Butler Route.

WHEREAS, the City of Saint Paul ("City") owns real property comprised of adjacent parcels, 677 Pierce Butler Route and 689 Pierce Butler Route (“City Property”); and
WHEREAS, under a 2023 Temporary Access, Construction and Maintenance Permit the City currently allows Rail Transfer, Inc., a Saint Paul inter-modal trucking firm ("Rail Transfer"), to maintain a temporary driveway across the City Property between Pierce Butler Route on the south and the Burlington Northern & Santa Fe Railway property on the north that Rail Transfer leases for its business operations ("Existing Driveway"); and
WHEREAS, Rail Transfer desires continued access across the City Property, but can no longer do so at the location of the Existing Driveway because said driveway conflicts with other planned City uses; and
WHEREAS, the City has agreed to allow Rail Transfer to demolish and remove the Existing Driveway and construct a new driveway and related slope and drainage improvements to provide a stable access route across the City Property for Rail Transfer’s use, said new driveway to be located along the westerly edge of the 689 Pierce Butler Route property and within platted Hubbard Street; and
WHEREAS, said demolition and construction activities will be performed in accordance with the City’s plans and specifications for the work, as documented in a new Driveway Access Easement and Maintenance Agreement ("Agreement"), and provided in Exhibit A attached hereto; now, therefore, be it
RESOLVED, that City Council hereby approves the Agreement and authorizes and directs the proper city officials to execute same in a form and content substantially as set forth in Exhibit A.
