Title

Approving a Release of Covenant and recording of a new Parkland Covenant between the City and Snelling-Midway Redevelopment, LLC pertaining to the Great Lawn Parkland Agreement.

Body

WHEREAS, on February 1, 2018 the City of Saint Paul ("City") entered into that certain Parkland Agreement with MUSC Holdings, LLC ("MUSC") in fulfillment of the City's parkland dedication requirement for MUSC's redevelopment of land at the soccer stadium site; and

 

WHEREAS, the Parkland Agreement set forth requirements for design, construction, use and maintenance of MUSC-owned land, identified as Outlot C of the 2017 plat MLS Soccer Redevelopment, Ramsey County, Minnesota (the "Park"), that was to be dedicated for public park purposes; and

 

WHEREAS, in compliance with Saint Paul Legislative Code Sec. 69.511(c)(4), a recordable covenant (the "Current Parkland Covenant"), attached hereto as Exhibit A, was required to subject the Park property to the requirements of the Parkland Agreement, and was recorded on August 9, 2024 with the Ramsey County Registrar's Office as Document Number T02779099; and

 

WHEREAS, the Current Parkland Covenant was incorrectly recorded against Outlot A, MLS Soccer Redevelopment; and

 

WHEREAS, said Outlots A and C are now owned by Snelling-Midway Redevelopment, LLC ("Snelling-Midway"); and

 

WHEREAS, the City and Snelling-Midway desire to correct said recording error by filing a Release of Covenant, attached hereto as Exhibit B, against said Outlot A, and by filing a new Parkland Covenant, attached hereto as Exhibit C, against said Outlot C; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council hereby authorizes and directs the proper city officials to execute said Release of Covenant, to be recorded against Outlot A, MLS Soccer Redevelopment, and to execute said new Parkland Covenant, to be recorded against Outlot C, MLS Soccer Redevelopment.
