Authorizing the Department of Parks and Recreation to enter into a grant agreement with and provide indemnification for the State of Minnesota to accept a $218,000 LCCRM grant for the Como Woodland Outdoor Classroom on behalf of the City.
 
Body
WHEREAS, the Legislative-Citizen Commission on Minnesota Resources (LCCMR) is dedicated to preserving, protecting, restoring and enhancing the natural resources that are the collective heritage of every Minnesotan; and
 
WHEREAS, it is the function of the LCCMR is to make funding recommendations to the state legislature for special environment and natural resource projects, primarily from the Environment and Natural Resources Trust Fund, to maintain and enhance Minnesota's environment and natural resources; and
 
WHEREAS, the City of Saint Paul, Department of Parks and Recreation completed a master plan for the Como Woodland Outdoor Classroom in 2009; and
 
WHEREAS, the Department of Parks and Recreation applied for $218,000 in grant funding through the LCCMR in 2009 to construct trails and restore native habitat within the Como Woodland Outdoor Classroom as indicated in the master plan for the classroom; and
 
WHEREAS, the LCCMR recommended this project for funding and the 2010 Minnesota Legislature adopted the LCCMRs recommendations; and
 
WHEREAS, the grant agreement requires indemnification of the State of Minnesota from all claims, actions, or suits of any character brought for or on account of any claimed or alleged injuries or damages received by any person or property arising out of the use of the Como Woodland Outdoor Classroom; and
 
WHEREAS, the City Council finds that there is a public purpose in accepting the funds and improving the Como Woodland Outdoor Classroom as indicated in the master plan, and that such an indemnification will permit the improvements to go forward; now, therefore, be it
 
RESOLVED, that the City of Saint Paul shall act as legal sponsor for the project contained in MN Laws 2010, Chapter 362, Article 1, Section 2, Subdivision 8(e), Get Outside - Urban Woodland for Kids; and be it
 
FURTHER RESOLVED, that the City of Saint Paul has the financial capability to ensure adequate completion of the project and certifies that it will comply with all applicable laws and regulations as stated in the grant agreement; and be it
 
FINALLY RESOLVED, that the appropriate city officails are hereby authorized to execute such agreements as may be necessary to accept this grant on behalf of the City.
