Approving adverse action against the Tow Truck/Wrecker (Operator) and Tow Truck/Wrecker (Vehicle) license applications submitted by ARRC Enterprise, LLC d/b/a Stress Less Towing Powered by ARRC (License ID# 20230000508) for the premises located at 118 Acker Street East.

Body

 

WHEREAS, the Tow Truck/Wrecker (Operator) and Tow Truck/Wrecker (Vehicle) license applications submitted by ARRC Enterprise, LLC d/b/a Stress Less Towing Powered by ARRC (License ID# 20230000508) for the premises located at 118 Acker Street East in Saint Paul were the subject of a Notice of Intent to Deny License (“Notice”) dated August 24, 2023; and   

 

 

WHEREAS, the Notice stated that on May 24, 2023, the license applicant (“Applicant”) received an email from a DSI Inspector stating that in order to complete processing the application the licensee needed to submit the required information; and

 

 

WHEREAS, on May 30, 2023, the applicant received a second (2nd) email from a DSI Inspector concerning possible relocation of the business.  The applicant was informed that if he was to relocate he would need to start a whole new application and go through process again; and

 

 

WHEREAS, on June 21, 2023, the applicant was sent a third (3rd) email from a DSI Inspector with an attached Request for Withdraw/Request for Refund form informing the  applicant that DSI would need something in writing if he chose to withdraw the license applications; and

 

 

WHEREAS, on July 6, 2023, the applicant was sent a fourth (4th) email from a DSI Inspector and two (2) letters to inform the applicant that time has elapsed to submit a property lease or proof of ownership as well as a letter stating location and security of the lot for the applications submitted; and

 

 

WHEREAS, the letter then gave the applicant until July 17, 2023 to take appropriate action or the Department of Safety and Inspections would recommend adverse action be taken to deny the license applications; and

 

 

WHEREAS, the Notice of Intent to Deny Licenses (“Notice”) gave the applicant until September 5, 2023 to either:  1) submit the required information requested by DSI; 2) request a hearing before City Council; 3) request an administrative hearing or 4) complete and return the Request to Withdraw/Request for Refund form; and

 

 

WHEREAS, the applicant failed to respond to the Notice by September 5, 2023 to: 1) submit the required information requested by DSI; 2) request a hearing before City Council; 3) request an administrative hearing or 4) complete and return the Request to Withdraw/Request for Refund form; and

 

 

WHEREAS, the Notice stated that if the applicant failed to respond to the Notice by September 5, 2023, that the matter would be placed on the City Council Consent Agenda to impose the recommended penalty; now, therefore, be it

 

RESOLVED, the Tow Truck/Wrecker (Operator) and Tow Truck/Wrecker (Vehicle) license applications submitted by ARRC Enterprise, LLC d/b/a Stress Less Towing Powered by ARRC (License ID# 20230000508) for the premises located at 118 Acker Street East in Saint Paul are hereby denied
