Resolution Authorizing Conveyance of Real Property at the Southwest Corner of Maryland Avenue and Clarence Street to Ramsey County; Greater East Side, District 2

 

Body

WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (“HRA”), has duly adopted and there is now lawfully in effect in the City of Saint Paul, Minnesota, a City Wide Redevelopment Plan providing for the acquisition, clearance and resale of land for redevelopment and the Greater East Side District 2 area is a part of this Plan; and

 

WHEREAS, the HRA has also adopted the Phalen Village Small Area Plan in December, 1995 (“Small Area Plan”) which is consistent with Transit and Circulation Policy No. 2, for making Maryland less of a barrier for pedestrians and extending the three-lane section east to White Bear Avenue; and

 

WHEREAS, the HRA owns property at the Southwest Corner of Maryland Avenue and Clarence Street (the “HRA Parcel”) which is undevelopable due to the small size of the lot; and

 

WHEREAS, the HRA Parcel is legally described as: “The Easterly 10 feet of the Northerly 20 feet of Lot 1, Block 1, KIEFER-PARK”, and

 

WHEREAS, Ramsey County needs the HRA Parcel for widening of Maryland Avenue and has submitted a proposal to HRA requesting the conveyance of the use of the HRA Parcel to them for this purpose; and

 

WHEREAS, Ramsey County has proposed to pay to HRA the sum of $4000.00 for conveyance of the HRA Parcel; and

 

WHEREAS, said proposal, pursuant to due notice thereof was published in the Saint Paul Pioneer Press on October 30, 2010, and a public hearing on said proposal and proposed sale and provisions thereof, was held on Wednesday, November 10, 2010 at 2:00 p.m., Central Standard Time, Third floor City Hall, 15 West Kellogg Boulevard, in the City of Saint Paul, Minnesota; and

 

WHEREAS, the HRA, pursuant to the provisions of Minnesota Statutes, Sections 469.029 and  469.032 agrees to sell the HRA Parcel for use in accordance with the City Wide Redevelopment Plan and Small Area Plan, of which the Greater East Side District 2 area is a part; and

 

WHEREAS, the disposal price of the HRA Parcel is in accordance with and subject to the restrictions of the City Wide Redevelopment Plan and Small Area Plan; and

 

NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota as follows:

 

1.                     That the proposal to sell the HRA Parcel to Ramsey County conforms to the objectives and specific                      requirements of the City Wide Comprehensive Plan and Small Area Plan.

                                          

2.                     That the sum of  FOUR THOUSAND AND No/100 DOLLARS ($4,000.00) for the HRA Parcel is satisfactory for transfer of real property to Ramsey County for use as street widening.

 

3.                     That the proposed disposal transaction by and between HRA and Ramsey County is satisfactory in form and complies with the requirements of state and federal law.

 

4.                     That the execution and delivery of a Deed of Conveyance of Disposition of the HRA Parcel is hereby authorized by the HRA Board of Commissioners, to be executed on its behalf by the Chairperson or his or her designated Commissioner of the HRA.
