Approving an amended and restated lease agreement and related cooperative agreement between the City of Saint Paul and Ramsey County for the Police Department's ongoing use of County property for the outdoor shooting range.
Body
WHEREAS, Ramsey County ("County") has requested an amendment and restatement of the existing lease ("1974 Lease") between the City of Saint Paul ("City") and the County for the Saint Paul Police Department's ("SPPD") continued use of the outdoor shooting range located in Maplewood, Minnesota; and
WHEREAS, since 1974 the City has used 7.24 acres of County-owned land along Linwood Avenue East near Century Avenue South in Maplewood ("Leased Premises") for said outdoor shooting range; and
WHEREAS, key provisions of the 1974 Lease include no compensation for rent and a 99-year term ending on December 31, 2073; and
WHEREAS, the SPPD has made improvements to the Leased Premises, and uses the Leased Premises for training and shooting certification purposes; and
WHEREAS, the SPPD has an ongoing need to use the Leased Premises for said purposes; and
WHEREAS, the County desires to amend and restate the 1974 lease to clarify the rights and responsibilities of the parties for use of the Leased Premises, as provided in Exhibit A attached hereto ("Amended Lease"); and
WHEREAS, the City has begun to implement the use of noise suppressors for training with long guns on the Leased Premises, and the County finds it in the public interest to contribute to the cost of the suppressors; and
WHEREAS, the City and the County desire to enter into a cost-sharing agreement for the purchase of said sound suppressors, as provided in Exhibit B attached hereto ("Cooperative Agreement"); and
WHEREAS, the Amended Lease and Cooperative Agreement include liability provisions whereby each party agrees to be responsible for its own acts and omissions and those of its officers and employees in connection with use of the Leased Premises; and
WHEREAS, the City Council finds that SPPD's ongoing use of the Leased Premises will assist SPPD's efforts to provide effective law enforcement services for local citizens, and therefore supports the SPPD's and County's efforts to enter into the Amended Lease and Cooperative Agreement; now, therefore, be it
RESOLVED, that the City Council hereby authorizes the proper city officials to execute the Amended Lease and Cooperative Agreement in a form and content substantially as set forth in Exhibits A and B attached hereto.
