Approving the adverse action against the Liquor on Sale- 101-180 seats, Liquor on Sale- 2am, Liquor on Sale- Sunday, Entertainment (B) Liquor Outdoor Service Area- Patio, and Gambling Location licenses held by RAS Ethiopian Bar & Restaurant LLC d/b/a RAS Restaurant & Lounge (License ID# 20100000062) for the premises located at 2516 7th Street West.

WHEREAS, the Notice stated that on January 15, 2020 the Department of Safety and Inspections sent the licensee a License Enforcement Notice to address the parking behind the building in an area that is not a part of the original site plan; and
WHEREAS, On September 15, 2021, it was discovered by the Department of Safety and Inspections that parking was still allowed in the unapproved area of the parking lot
WHEREAS, an inspection of the Licensed Premises was conducted on September 15, 2021, and violations observed by the Inspector were documented with photographs including 10 cars parked in the unapproved area of the parking lot and no required chains or parking concrete stops to prohibit parking in the area; and
WHEREAS, this is the second (2nd) violation within twelve (12) months, and pursuant to Saint Paul Legislative Code § 310.05 (m) (1), the licensing office recommended a $1000.00 matrix penalty; and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $1000.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $1000.00 matrix penalty or request a public or administrative hearing by February 10, 2022, that the matter would be placed on the next available consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Liquor on Sale- 101-180 seats, Liquor on Sale- 2am, Liquor on Sale- Sunday, Entertainment (B) Liquor Outdoor Service Area- Patio, and Gambling Location licenses held by RAS Ethiopian Bar & Restaurant LLC d/b/a RAS Restaurant & Lounge (License ID# 20100000062) for the premises located at 2516 7th Street in Saint Paul is hereby ordered to pay a matrix penalty of $1000.00 for failure to follow site plan and set up barriers to prohibit parking in unapproved area.
Payment of such penalties shall be made within thirty (30) days of the date of the adoption of this resolution
