Title

Approving the Auto Repair Garage and Auto Body Repair/Painting Shop licenses for Brothers Auto Repair LLC d/b/a Brothers Auto Repair Bersain Morales Escobar (License ID #20230001820) for the premises located at 881 Newcomb Street.

Body

WHEREAS, Brothers Auto Repair LLC d/b/a Brothers Auto Repair Bersain Morales Escobar (License ID #20230001820) applied for an Auto Repair Garage and Auto Body Repair/Painting Shop licenses for the premises located at 881 Newcomb Street in Saint Paul; and   

WHEREAS, on October 18, 2023, the Department of Safety and Inspections sent out the required License Application Notification; and 

WHEREAS, in response to the October 18, 2023, notification, the Department of Safety and Inspections received no objections to approval of the licenses; and 

WHEREAS, the Council finds that the application is in order, the proposed license conditions are reasonable and there are no grounds to deny approval of the license; now, therefore, be it,

RESOLVED, the Auto Repair Garage and Auto Body Repair/Painting Shop licenses are hereby approved and issued to Brothers Auto Repair LLC d/b/a Brothers Auto Repair Bersain Morales Escobar (License ID #20230001820) for the premises located at 881 Newcomb Street in Saint Paul with the following license conditions:

1.                     All vehicles must be parked according to the current approved site plan on file with the Department of Safety and Inspections (DSI). The total number of vehicles parked on the property shall not exceed that shown on the plan. (Any changes to the site plan must be approved by the Zoning Administrator).

2.                     No customer vehicles under the control of the licensee can be parked and or stored in the public right-of-way. This includes vehicles waiting for repairs and vehicles waiting to be picked up by the customer.

3.                     There shall be no exterior storage of vehicle parts, tires, oil or any other similar materials associated with the business. Trash will be stored in a covered dumpster.

4.                     The license holder agrees to maintain the fencing, vehicle location and vehicle barriers in a manner consistent with the approved site plan.

5.                     Vehicle sales and/or the display of vehicles for sale is not permitted.

6.                     Vehicle salvage is not permitted.

7.                     No auto repair, auto body repair, or painting of vehicles may occur on the exterior of the lot or in the public right-of-way. All repair work must occur within an enclosed building.

8.                     Customer vehicles may not be parked longer than 10 days on the premises. It shall be the responsibility of the licensee to ensure than any vehicle not claimed by its owner is removed from the lot as permitted by law.

9.                     Provide maneuvering space on the property to allow vehicles entering and exiting the site to proceed forward as stipulated on the approved site plan.

10.                     Licensee must comply with all federal, state, and local laws.

11.          Storage of vehicle fluids, batteries, etc. shall be in accordance with Ramsey County Hazardous Waste Regulations.
