Approving adverse action against the Tree Trimmer, Tree Trimmer Vehicle, and Tree Trimmer Additional Vehicle license applications submitted by Minnesota Tree Experts LLC d/b/a Minnesota Tree Experts (License ID# 20230000536) for the premises located at 7527 Oliver Avenue North Brooklyn Park, MN 55444.

WHEREAS, the Tree Trimmer, Tree Trimmer Vehicle, and Tree Trimmer Additional Vehicle license applications submitted by Minnesota Tree Experts LLC d/b/a Minnesota Tree Experts (License ID# 20230000536) for the premises located at 7527 Oliver Avenue North in Brooklyn Park were the subject of a Notice of Intent to Deny License (“Notice”) dated November 6, 2023; and
WHEREAS, the Notice stated that on March 17, 2023, the applicant submitted three Class “R” license applications for tree trimming, tree trimmer vehicle, and tree trimmer additional vehicle licenses.
WHEREAS, on April 28, 2023, an Inspector from the Department of Safety and Inspections (“DSI”) emailed the licensee regarding the need to have the vehicles inspected and asked the applicant where the Tree Trimmer Vehicles would be stored; and
WHEREAS, on May 23. 2023, an Inspector from DSI left a voicemail with the license applicant regarding the need to get vehicle inspections scheduled; and
WHEREAS, on October 3, 2023, an Inspector from DSI left a voicemail regarding the need to get vehicle inspections scheduled. The inspector gave the applicant a deadline to respond by, October 17, 2023; and
WHEREAS, on October 3, 2023, an Inspector from DSI sent an email to asking the applicant to submit the required information and gave the applicant until October 17, 2023, to respond; and
WHEREAS, on October 23, 2023, an Inspector from DSI left a voicemail giving the applicant a last chance to provide all the information regarding the licenses; and
WHEREAS, the Notice of Intent to Deny Licenses (“Notice”) gave the applicant until November 16, 2023 to either: 1) submit the required information requested by DSI; 2) request a hearing before City Council; 3) request an administrative hearing or 4) complete and return the Request to Withdraw/Request for Refund form; and
WHEREAS, the applicant failed to respond to the Notice by November 16, 2023 to: 1) submit the required information requested by DSI; 2) request a hearing before City Council; 3) request an administrative hearing or 4) complete and return the Request to Withdraw/Request for Refund form; and
WHEREAS, the Notice stated that if the applicant failed to respond to the Notice by November 16, 2023, that the matter would be placed on the City Council Consent Agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Tree Trimmer, Tree Trimmer Vehicle, and Tree Trimmer Additional Vehicle license applications submitted by Minnesota Tree Experts LLC d/b/a Minnesota Tree Experts (License ID# 20230000536) for the premises located at 7527 Oliver Avenue North Brooklyn Park, MN 55444 are hereby denied.
