Stated Reason for Appeal (if given): The property owner purchased the property in July 2020 and reported that there were no containers on site at this time for yard waste. She called Highland and requested new carts. The customer service representative that she spoke to stated that she was responsible for the $150 cart fee from the missing garbage cart and that Highland would not start yard waste until she paid for the garbage cart.
Staff Comments: Hauler confirmed that the property owner did call in 08/2020 to report that there were no yard waste carts at the property and to cancel yard waste service. During this call the customer service representative explained that they would have to charge her a missing cart fee of $150. This is supported by the fact that the property has received yard waste service since the beginning of the city contract. This has been verified by a photo taken of a yard waste cart at the property in October 2019. There are also no records of cart removal from the property. Therefore the city agrees that there should be a charge for a missing cart. However, the city does not agree with the amount of the missing cart fee. The most the haulers can charge for a missing cart is $75. Therefore staff recommends reducing the assessment to $75.00.

WHEREAS, the Office of Financial Services Real Estate Section has attached to this Council File both a report of completion outlining the costs and fees associated with Collection of Delinquent Garbage Bills for services during October to December 2020. (File No. CG2101A1, Assessment No. 210100) and the assessment roll including all properties for which these assessments are proposed for Council ratification; and
WHEREAS, the City Council’s Legislative Hearing Officer has reviewed an appeal of this assessment and developed a recommendation for the City Council with respect to this assessment; and
WHEREAS, a public hearing having been conducted for the above improvement, and said assessment having been further considered by the Council and having been considered financially satisfactory; Now, Therefore, Be It
RESOLVED, that pursuant to Chapter 14 of the Saint Paul City Charter, said assessment is hereby deleted.
