Title

Approving the application for change of ownership to the Wine On Sale and Malt On Sale (Strong) license now held by Christopher & Daphne LLC d/b/a Mandalay Kitchen (License ID #20240000265) for the premises located at 383 University Avenue West.

WHEREAS, on December 19, 2023, Christopher & Daphne LLC d/b/a Mandalay Kitchen (License ID #20240000265) applied for a change of ownership to the Wine On Sale and Malt On Sale (Strong) license for the premises 383 University Ave W., in Saint Paul; and

WHEREAS, the license application notification was sent out by the Department of Safety and Inspections (DSI) on August 1, 2024, with a response date of August 16, 2024; and

WHEREAS, in response to the notification no objections or comments were received; and

WHEREAS, the Council finds that the application is in order and there are no grounds to deny approval of the license; now, therefore, be it,

RESOLVED, the change of ownership for the Wine On Sale and Malt On Sale (Strong) license is hereby approved and issued to Christopher & Daphne LLC d/b/a Mandalay Kitchen (License ID #20240000265) for the premises located at 383 University Ave W., in Saint Paul with the following existing licensing conditions:

1.                     Per City of Saint Paul Legislative Code 409.13(a)(2), On-sale wine license shall mean a license authorizing the sale of wine not exceeding fourteen (14) percent alcohol by volume, for consumption on the licensed premises only in conjunction with the sale and service of food (menu item only). The sale of Malt (Strong) will also take place only in conjunction with the sale and service of food.

 

2.                     Per City of Saint Paul Legislative Code 409.13(e), licensee must be able to show that gross receipts are at least sixty (60) percent attributable to the sale of food.

 

3.                     Licensee will submit to the Department of Safety and Inspections (DSI) annual gross receipts for food and liquor for each year the license is renewed.
