Title

Approving the application for change of ownership to the Second Hand Dealer - Motor Vehicle and Auto Repair Garage license now held by Elite Auto LLC d/b/a Elite Auto LLC (License ID #20240001351) for the premises located at 336 Larpenteur Avenue West.

Body

 

WHEREAS, on August 6, 2024, Elite Auto LLC d/b/a Elite Auto LLC (License ID #20240001351) applied for a change of ownership to the Second Hand Dealer - Motor Vehicle and Auto Repair Garage license for the premises 336 Larpenteur Ave W, in Saint Paul; and

WHEREAS, the license application notification was sent out by the Department of Safety and Inspections (DSI) on August 23, 2024, with a response date of September 7, 2024; and

WHEREAS, on August 13, 2024, the Department of Safety and Inspections received a letter from North End Neighborhood Organization stating their support for the issuance of the license; and

WHEREAS, in response to the notification no objections or comments were received; and

WHEREAS, the Council finds that the application is in order and there are no grounds to deny approval of the license; now, therefore, be it,

RESOLVED, the change of ownership for the Second Hand Dealer - Motor Vehicle and Auto Repair license is hereby approved and issued to Elite Auto LLC d/b/a Elite Auto LLC (License ID #20240001351) for the premises located at 336 Larpenteur Ave W., in Saint Paul with the following existing license conditions:

CONDITION # 1 PER CONDITIONAL USE PERMIT (CUP) #19-025272:

1.                     Construction and maintenance of an obscuring fence along the south property line adjoining City parkland.

 

ADDITIONAL LICENSE CONDITIONS #2-11:

2.                     All customer, employee, business, and for-sale vehicles must be parked in accordance with the approved site plan on file with the Department of Safety and Inspections (DSI). The total number of vehicles parked on the property shall not exceed that shown on the approved plan. Licensee agrees to limit the number of for-sale vehicles parked on the property to that shown on the approved plan and shall not park for-sale vehicles in required customer/employee/handicap parking spaces as per the plan.

 

3.                     The parking lot shall be maintained in good order and repair in accordance with the approved site plan on file with DSI. This includes striping of the individual parking spaces, landscaping, fencing, signage etc. Weather resistant signage shall be installed clearly identifying the location of each customer/employee/handicap parking space.

 

4.                     There shall be no exterior storage of vehicle parts, tires, oil or any other similar materials associated with the business. Trash will be stored in a covered dumpster. Storage of vehicle fluids, batteries, etc. shall be in accordance with the Ramsey County Hazardous Waste regulations.

 

5.                     No vehicles under the control of the licensee can be parked and or stored in the driveway, maneuvering lanes, or in the public right of way (e.g., street, alley, sidewalk, boulevard, etc.) This includes for-sale vehicles, sold vehicles waiting to be picked up by the customer, vehicles waiting for repairs and repaired vehicles waiting to be picked up by the customer.

 

6.                     The storage of vehicles for the purpose of salvaging parts if expressly forbidden.  All vehicles parked outdoors must appear to be completely assembled with no major body parts missing. Vehicle salvage is not permitted.

 

7.                     No repair of vehicles may occur on the exterior of the lot or in the public right-of-way (e.g., street, alley, sidewalk, boulevard, etc.) All repair work must occur within an enclosed building.

 

8.                     Auto body repair and/or auto body spray painting is not permitted.

 

9.                     Customer vehicles may not be parked longer than ten (10) days on the premises. It shall be the responsibility of the licensee to ensure that any vehicle not claimed by its owner is removed from the lot as permitted by law.

 

10.                     Provide maneuvering space on the property to allow vehicles entering and exiting the site to proceed forward. Backing from the street or on the street prohibited.

 

11.                     Licensee must comply with all federal, state and local laws.
