Amending the appendix to Chapter 409 of the Legislative Code pursuant to Section 17.07.1 of the Charter and Section 409.16 of the Legislative Code to create four (4) distinct Commercial Development Districts within the area known as the Creative Enterprise Zone and allow for nine (9) On-Sale Liquor Licenses of any type, notwithstanding on-sale liquor licenses allowed under § 409 of the Legislative Code, to be distributed among the four (4) Districts.

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
SECTION 1
WHEREAS, the owner of Paikka (“Owner”) at 550 Vandalia Street in the City of Saint Paul requested the creation of a Commercial Development District so that Paikka Event Center could sell and serve alcoholic drinks, including hard liquor to customers and that request is herein incorporated as Exhibit 1; and
WHEREAS, a Creative Enterprise Zone Entertainment District was created and defined within Saint Paul Legislative Code as that portion of the City of Saint Paul lying within and bounded by the following streets: Beginning at the intersection of North Eustis Street with Wabash Avenue, Wabash Avenue to Vandalia Street, Vandalia Street to the train tracks, follow the train tracks South East to Cleveland Avenue North, Cleveland Avenue North across University Avenue West where it turns into Transfer Road to a point one (1) block due west across the train tracks from West Minnehaha Ave, from the point one (1) block due west across the train tracks from West Minnehaha Ave intersecting Transfer Road to the intersection of Prior Avenue North and West Minnehaha Avenue, Prior Avenue North to the intersection of Hewitt Avenue, from the intersection of Prior Avenue North and Hewitt Avenue due west to Transfer Road, Transfer Road south to Ellis Avenue, Ellis Avenue to Vandalia Street, Vandalia Street to Capp Road, Capp Road North West as it wraps around South to Wycliff Street continued on to the intersection of Wycliff Street and Hersey Street, Hersey Street to West Territorial Road, West Territorial Road to North Eustis Street, and then North Eustis Street to Wabash Avenue; and
WHEREAS, the Owner recognized the connection between their request and the overlying value to create Commercial Development Districts within the Creative Enterprise Zone; and
WHEREAS, the Department of Safety and Inspections has met and discussed with businesses, property owners, Saint Anthony Park Community Council, and Creative Enterprise Zone representatives to discuss the creation of a Creative Enterprise Zone Commercial Development District pursuant to Saint Paul City Charter §17.07.1 and Saint Paul Legislative Code §409.16; and
WHEREAS, based on input, the City’s interest in aligning the boundaries of various types of districts and ensuring public health and safety, the Creative Enterprise Zone Commercial Development District is proposed to have four (4) distinct Commercial Development Districts within the Creative Enterprise Zone; and
WHEREAS, the four (4) distinct Commercial Development Districts within the Creative Enterprise Zone are defined in Exhibit 2, and
WHEREAS, on January 10, 2024, the Saint Paul City Council approved RES 24-21 (herein incorporated as Exhibit 3), which waived the petition requirement, allowing the Commercial Development District to move forward for consideration; and
WHEREAS, Saint Paul Legislative Code Section 409.16 requires that the planning commission must be “consulted for advice concerning the proposals for consistency with the city’s comprehensive plan and zoning ordinances, and the planning commission must report in writing to the city council its findings and recommendation”; and
WHEREAS, the report containing the findings and recommendations of the planning commission is herein incorporated as Exhibit 4; and
WHEREAS, the final resolution of the Planning Commission is herein incorporated as Exhibit 5; and
WHEREAS, §17.07.1 of the Saint Paul City Charter requires that “Reasonable public notice of the proposed commercial development district shall be given by the license inspector to residents and organization in the ward or wards in which said district is to be located”; and
WHEREAS, §409.16 (d) of the Saint Paul Legislative Code states that “mailed notice thereof must be given by the Department of Safety and Inspections to all owners of land within the new or area of the expanded district. Published notice must be made at lease twenty (20) days in advance of the public hearing”; and
WHEREAS, such notice was given by the Department of Safety and Inspections and is herein incorporated as Exhibit 6; and
WHEREAS, such notice was given by the City Clerk and is herein incorporated as Exhibit 7; and
WHEREAS, a public hearing before City Council was conducted on February 14, 2024, at which all interested parties were given an opportunity to be heard, the Council having considered all the facts and recommendations concerning the application; now therefore be it
RESOLVED, that the Council of the City of Saint Paul does hereby ordain:
SECTION 2
The Council finds that the notice provisions under Saint Paul Legislative Code §409.16 (d) have been satisfied by RES 24-21 waiving the petition requirement of the owners of land within the area of the expanded district.
SECTION 3
That the four (4) Creative Enterprise Zone Commercial Development Districts, as shown in Exhibit 26, which is attached to and incorporated by reference in this ordinance pursuant to §17.07.1 of the Saint Paul City Charter and § 409.16 of the Saint Paul Legislative Code. The legal description of the four (4) Creative Enterprise Zone Commercial Development Districts, attached herein as Exhibit 8.
This district and its legal description shall appear in the Appendix to Chapter 409 of the Saint Paul Legislative Code.
SECTION 4
That the four (4) Creative Enterprise Zone Commercial Development Districts shall in total be limited to no more nine (9) On Sale Liquor Licenses of any type, notwithstanding on-sale liquor licenses allowed under § 409 of the Saint Paul Legislative Code, and distributed in the following manner: no more than two (2) total in the NW District, no more than three (3) total in the NE District, no more than two (2) total in the SW District, and no more than two (2) total in the SE District.
SECTION 5
This Ordinance shall take effect and be in force thirty (30) days following its passage, approval and publication.
