Appeal of Ray VinZant, VinZant Construction, to a Reinspection Fire Certificate of Occupancy With Deficiencies (which includes condemnation of the basement) and Summary Abatement Order at 1247 ROSS AVENUE.

Purpose of Appeal: The order states that we must comply before December 7, 2017. We are appealing this order because we need more time to comply. The main reasons we need more time to comply are:
1) The tenants are elderly family members and have strong attachment to all of their belongings. We will need more time to work with the tenants to sort through all the belongings, keep and store what is to be kept, and to dispose what is to be discarded;
2) The tenant have medical issues which limit the amount of time that we are able to work with them to comply with the order.

WHEREAS, in the matter of the Appeal of Ray VinZant, VinZant Construction, to a Reinspection Fire Certificate of Occupancy With Deficiencies (which includes condemnation of the basement) and Summary Abatement Order at 1247 ROSS AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council 1) grant the appeal on the condemnation of the basement room as the tenant has been vacated, noting the inspection date of December 14 at 10 a.m. remains; and 2) deny the appeal on the summary abatement order, noting enforcement is stayed until after the city council public hearing; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
