Amending Chapters 19 and 160 of the Legislative Code pertaining to the power of right of way inspectors to issue citations. (To be withdrawn)

 

Body

SECTION 1

WHEREAS, right of way inspectors are essential city staff who make sure that public and private construction and maintenance activities can safely occur in the public right of way throughout the year; and

 

WHEREAS, as an urban city, on-street parking is a necessity for our residents, businesses, and visitors; and

WHEREAS, to allow city and private entities access to the public right of way for permitted activities, such as construction and street maintenance, which require residents and visitors to temporarily move their cars from certain areas in the street and public right of way; and

WHEREAS, the city has the authority to issue citations based on state statute; and

 

WHEREAS, Chapters 19 and 160 of the Saint Paul Legislative Code govern the power of inspectors to issue citations; and

 

WHEREAS, the Public Works Department has found it necessary to update Chapters 19 and 160 to allow Public Works right of way inspectors the authority to enforce Legislative Code in the public right of way; now, therefore, be it

 

RESOLVED, that the Council of the City of Saint Paul does Ordain:

 

SECTION 2

 

Chapter 19 of the Saint Paul Legislative Code is hereby amended as follows:

 

Sec. 19.01. - Power of inspectors to issue citations.

 

All duly appointed, qualified and acting inspectors of either the departments of the city or the board of water commissioners shall have the same power as possessed by police officers of the city to issue citations in the same manner and with the same force and effect as citations issued by police officers, but such citations shall relate only to violations of the Saint Paul Legislative Code relating to building construction, operation and maintenance; fire and fire prevention; landlord notification of voter registration information; public health and sanitation; water code; and zoning. Said citations shall  conform to the Statewide Standard Citation form approved by the State Court Administrator and the Commissioner of Public Safety.

 

 

Sec. 19.02. - Power of park security officers to issue citations.

 

All duly appointed, qualified and acting park security officers shall have the power to issue citations in the same manner and with the same force and effect as citations issued by police officers, but such authority shall be limited to violations of the Saint Paul Legislative Code which the officers observe occurring on property under the jurisdiction or control of the department of parks and recreation of the city. Said citations shall  conform to the Statewide Standard Citation form approved by the State Court Administrator and the Commissioner of Public Safety.

 

 

Sec. 19.03 - Power of public works right-of-way inspectors to issue citations.

 

All duly appointed, qualified and acting public works right-of-way inspectors shall have the power to issue citations in the same manner and with the same force and effect as citations issued by police officers, but such authority shall be limited to violations of the Saint Paul Legislative Code relating to construction, operation, environmental compliance, and maintenance of the city’s public works infrastructure; public right-of-way permits; and parking restrictions directly associated with projects and operations under the control or responsibility of the department of public works.  Said citations shall conform to the Statewide Standard Citation form approved by the State Court Administrator and the Commissioner of Public Safety.

 

 

Chapter 160 of the Saint Paul Legislative Code is hereby amended as follows:

 

Sec. 160.16. - Parking enforcement officers (PEOs) and community liaison officers (CLOs).

 

All duly appointed parking enforcement officers (PEOs), community liaison officers (CLOs), as amended from time to time, parking meter collectors, parking meter crew leaders,  parking meter repair personnel, and public works right-of-way inspectors are hereby empowered, authorized and directed to issue citations for parking meter and other parking violations.   The authority of public works right-of-way inspectors to issue citations under this section shall be limited to violations of the Saint Paul Legislative Code relating to parking meters under Chapter 160 and parking violations under Section 157.03 (a) (16) and (23) that are directly associated with projects and operations under the control or responsibility of the department of public works.  Said citations shall conform to the Statewide Standard Citation form approved by the State Court Administrator and the Commissioner of Public Safety and shall have the same force and effect as though issued by a police officer or other peace officer.
