Approving the addition of a Gambling Location license to the existing Liquor On Sale 181-290 seats, Liquor On Sale - Sunday, and Liquor Outdoor Service Area (sidewalk) licenses held by Green Mill LLC d/b/a Green Mill (License ID # 20130005371) for the premises located at 57 Hamline Avenue South.

WHEREAS, Green Mill LLC d/b/a Green Mills (License ID # 20130005371) applied for a Gambling Location License on October 16, 2023, to add to their existing Liquor On Sale 181-290 seats, Liquor On Sale - Sunday, and Liquor Outdoor Service Area (sidewalk) licenses for the premises located at 57 Hamline Avenue South in Saint Paul.; and
WHEREAS, on November 21, 2023, the Department of Safety and Inspections sent out the required License Application Notification with a December 6, 2023, response date; and
WHEREAS, in response to the November 21, 2023, notification, the Department of Safety and Inspections received no objections to the approval of a Gambling Location license; and
WHEREAS, the Council finds that the application is in order and there are no grounds to deny approval of the license; now, therefore, be it,
RESOLVED, a Gambling Location license are hereby approved and issued to Green Mill LLC d/b/a Green Mill (License ID # 20130005371) for the premises located at 57 Hamline Avenue South in Saint Paul with the following existing license conditions but with no new license conditions:
1. Sale of alcoholic beverages should be limited to 30% of total sales. Green Mill will continue to utilize all of its tables for full menu service.
2. Hard liquor service will terminate with the closing of the kitchen at 11pm on weekdays and midnight on weekends.
3. No Happy Hour specials on hard liquor drinks
4. No entertainment requiring a class B license is allowed.
5. A Designated Driver Program will continue to be promoted within the restaurant.
6. No dumping of glass and bottles into dumpsters by Green Mill cleanup staff before 7 am and after 10 pm.
7. No pickup of trash and/or recyclables before 7am on weekdays or 9am on weekends. Conditions 9 thru 13 added with request for the Liquor Outdoor Service license
8. Customers will not be seated at the outdoor sidewalk café after 8:30 PM and this outdoor café will be closed (unoccupied) at 9:30 PM.
9. Each year prior to the replacement of table(s) and/or chair(s) in the public right-of-way (i.e., sidewalk), the licensee agrees to obtain a new Obstruction Permit from the Department of Public works. Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that a failure to comply with this condition will result in adverse action being taken against all of their licenses.
10. Failure to comply with any of these conditions may be grounds for adverse action.
11. Sidewalk seating is approved for a maximum of thirty-six (36) seats.
