Approving Ordinance Permit 20242010007a for Sanitary Sewer Infrastructure installed by the Saint Paul Port Authority on The Heights project site at the following locations: on Ivy Avenue: Howard (MH6201) to East of Howard (MH6200); on Howard Street: Ivy Avenue (MH6201) to Cottage Avenue (MH6204); on Cottage Avenue: Howard Avenue (MH6204A) to Winthrop Avenue (MH6204).

Body

WHEREAS, the Saint Paul City Council has adopted the Hillcrest Master Plan and all Amendments to the Plan; and

 

WHEREAS, in 2019 Ordinance 19-39 was adopted by the City Council that provides for the Saint Paul Port Authority (SPPA) as “…responsible for the design, engineering, construction and delivery of public infrastructure…” on The Heights project; and

 

WHEREAS, in October of 2022 the SPPA submitted appropriate plans, reports, and exhibits to begin the Site Plan Review process for The Heights project under SPR# 23-064690; and

 

WHEREAS, Public Works’ Policy “Construction of Public Infrastructure by Private Developers Policy” provides minimum requirements for “…plan review of private developments seeking to install public infrastructure…” in the Public Right-of-Way; and

 

WHEREAS, the City’s Ordinance Permit Policy and associated Ordinances 122 & 123 provides for City installation of improvements completed by the SPPA on The Heights project; and

 

WHEREAS, the appropriate City Departments and City subject matter experts reviewed said Plans, Specifications, Reports, and Documents and found same to be in compliance with applicable Codes, Standards, and Policies such that approval with conditions was granted by the Department of Safety and Inspections on May 17, 2024 for the sanitary sewer system for site plan 23-064690; and

 

WHEREAS, on September 11, 2024, the appropriate Ordinance Permit was issued by the City to the SPPA for the purpose of completing certain sanitary sewer infrastructure improvements for The Heights project; and

 

WHEREAS, with the exception of possible warranty rework resulting from a future inspection(s) prior to the expiration of the warranty period, punch list work, and testing of stubs from sanitary manholes 6202 and 6203, the SPPA has completed the installation of certain public improvements for Ordinance Permit 20242010007a according to the requirements stated in Codes, Standards, and Specifications; and

 

WHEREAS, warranties are assigned per Codes, Standards, and Specifications; and

 

WHEREAS, the SPPA has satisfied most of the applicable requirements of the Ordinance Permit Acceptance process as required Codes, Standards, and Policies for the installation of certain public improvements such that a recommendation is made to the City Council that the public infrastructure identified in Ordinance Permit 20242010007a be accepted with conditions; now, therefore be it

 

RESOLVED, that the City Council accepts the infrastructure as so defined in the attached Exhibit A and pursuant to Codes, Standards, and Specifications for commencement of the warranty period following Council acceptance and with the following condition(s):

1.                     The acceptance of the sanitary sewer stubs for Habitat for Humanity Outlots B and D of Lot 1 Block 3 of The Heights plat is conditioned upon satisfactory ovality testing (mandrel testing) from MH6202 and MH6203 to the right-of-way line.

2.                     The punch list process for manholes and other structures has been deferred to when casting adjustments take place as part of the roadway ordinance permit acceptance process. Any punch list items for sanitary structure encountered as part of the punch list process shall be corrected as part of the applicable ordinance permit within which the punch list was created.

3.                     There is alignment between the Saint Paul Port Authority and the Public Works Department as to interim cleaning of the sanitary mains. By interim it is meant until such time as sanitary flow velocities are at or above 2.0 feet per second.
