THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

 

SECTION 1

 

Chapter 229 of the Saint Paul Legislative Code is hereby amended to read as follows:

 

Chapter 229. - Minors-Curfew

 

229.01 Purpose.

To protect the safety and welfare of juveniles, reduce juvenile victimization, reduce juvenile delinquency, and promote public health, safety, and wellness.

Sec. 229.012. - Restrictions on minors.

It shall be unlawful for any minor of the ages provided herein at the times specified herein to loiter, idle, wander, stroll or play in or upon the public streets, highways, roads, alleys, parks, playgrounds or other public grounds, public places or public buildings, places of entertainment or amusement, vacant lots and other unsupervised places open to the public in the City of Saint Paul:

(a) For a minor fifteen (15) years or younger the hours of restriction are between 10:00 p.m. and 4:00 a.m. daily.

(b) For any minor who is over fifteen (15) years of age and is under eighteen (18) years of age the hours of restriction are between 12:01 a.m. and 4:00 a.m. daily.

 

Sec. 229.03 - Skyway restrictions. 

It is unlawful for any minor seventeen (17) years of age or younger to be present in the pedestrian skyway system as defined in Legislative Code section 140.01 between the hours of 10:00 p.m. and 4:00 a.m. daily.
This section will expire and be of no further force or effect on December 31, 2019.

 

Sec. 229.024. - Duties of parents.

It shall be unlawful for the parent, guardian or other adult person havi
ng charge of a minor to permit or by lack of supervision and control allow that minor to violate sections 229.02 or 229.03 of the Saint Paul Legislative Code.

 

Sec. 229.035. - Business places not to allow violations.

It shall be unlawful for any business proprietor to permit a minor to remain at the proprietor's establishment during the hours prohibited by this chapter. Whenever a minor continues to remain at such an establishment after the proprietor of the establishment orders the minor to leave, the proprietor shall immediately notify the police department of the violation.

 

Sec. 229.04 6. - Exception.

The provisions of this chapter do not apply to a minor accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, to a minor who is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor,
or where the presence of said minor in said place or places is connected with or required by some legitimate business, trade or profession or occupation in which said minor is permitted by law to be engaged, or to a minor exercising protected First Amendment rights under the United States or Minnesota Constitutions.

 

Sec. 229.07. - Penalty

Violation of sections 229.02 and 229.03 is a petty offense.  Violation of sections 229.04 and 229.05 is a misdemeanor.
