Amending the Appendix to Chapter 409 of the Legislative Code Pursuant to Section 17.07.1 of the Charter and Section 409.16 of the Legislative Code to create a new Commercial Development District at 1079 Rice Street to include the single parcel that is at that address and allow for one (1) On-Sale Liquor License of any type.

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
SECTION 1
WHEREAS, Toua Xiong, owner of Hi Hi Event Center (“Owner”) at 1079 Rice Street in the City of Saint Paul requested the creation of a Commercial Development District so that Hi Hi Event Center could serve drinks, including hard liquor to customers and that request is herein incorporated as Exhibit 1; and
WHEREAS, Owner turned in 13 signatures out of a possible 19 signatures, herein incorporated as Exhibit 1, having a percentage of 68.4% of signatures possible, which meets the threshold required for a Commercial Development District to move forward for consideration; and
WHEREAS, Saint Paul Legislative Code Section 409.16 requires that the planning commission must be “consulted for advice concerning the proposals for consistency with the city’s comprehensive plan and zoning ordinances, and the planning commission must report in writing to the city council its findings and recommendation; and
WHEREAS, the report containing the findings and recommendations of the planning commission is herein incorporated as Exhibit 2; and
WHEREAS, the final resolution of the Planning Commission is herein incorporated as Exhibit 3; and
WHEREAS, §17.07.1 of the Saint Paul City Charter requires that “Reasonable public notice of the proposed commercial development district shall be given by the license inspector to residents and organization in the ward or wards in which said district is to be located”; and
WHEREAS, §409.16 (d) of the Saint Paul Legislative Code states that “mailed notice thereof must be given by the Department of Safety and Inspections to all owners of land within the new or area of the expanded district. Published notice must be made at lease twenty (20) days in advance of the hearing”; and
WHEREAS, such notice was given by the Department of Safety and Inspections and is herein incorporated as Exhibit 4; and
WHEREAS, such notice was given by the City Clerk and is herein incorporated as Exhibit 5; and
WHEREAS, a public hearing before City Council was conducted on February 22, 2023, at which all interested parties were given an opportunity to be heard, the Council having considered all the facts and recommendations concerning the application; now therefore be it
RESOLVED, that the Council of the City of Saint Paul does hereby ordain:
SECTION 2
The Council finds that the notice provisions under Saint Paul Legislative Code §409.16 (d) have been satisfied by the written waivers and approvals signed by the owners of land within the area of the expanded district.
SECTION 3
That the 1079 Rice Street (PIN 252923110195), as shown in Exhibit 6, which is attached to and incorporated by reference in this ordinance pursuant to §17.07.1 of the Saint Paul City Charter and § 409.16 of the Saint Paul Legislative Code. The legal description of the 1079 Rice Street Commercial Development District, attached herein as Exhibit 7, is AUERBACH & HAND'S ADDITION,TO LOTS 4 THRU LOT 6 BLK 26. This district and its legal description shall appear in the Appendix to Chapter 409 of the Saint Paul Legislative Code.
SECTION 4
That the 1079 Rice Street Commercial Development District shall be limited to no more than one (1) total On-Sale Liquor License of any type allowed under § 409 of the Saint Paul Legislative Code.
SECTION 5
This Ordinance shall take effect and be in force thirty (30) days following its passage, approval and publication.
