Title

Authorizing a change in the district council boundary between District 9 and District 17 pursuant to Chapter 95 of the Administrative Code.

 

Body

WHEREAS, on December 4, 2019, District Council 9 and District Council 17 (collectively hereinafter, “the Applicants”), pursuant to Admin. Code § 95.03.A.2, jointly applied to the Department of Planning and Economic Development (“PED”) requesting a boundary change between the two districts; and

 

WHEREAS, upon receipt of the application, PED staff, pursuant to Admin. Code § 95.04, duly investigated the Applicants’ procedures to validate whether the said application complied with the requirements under Admin. Code §§ 95.03.A(2), 03.B and 03.C; and

WHEREAS, PED staff investigated the application and, in a report dated January 8, 2020, which is incorporated herein by reference, found that the application met the requirements of Admin. Code §§ 95.03.A(2), 03.B and 03.C for the reasons set forth therein; and

WHEREAS, pursuant to Admin. Code § 95.04, the report further analyzed the application under Admin. Code § 95.07(A-F); and,

WHEREAS, based upon the forgoing analysis, the report, having weighed factors both in favor of and against granting the application as required under Admin. Code § 95.05, recommended approval of the application for a boundary change for the reasons stated therein; and

WHEREAS, based upon the report’s recommendation, the Council of the City of Saint Paul hereby finds that PED staff, in accordance with Admin. Code § 95.04, have investigated and analyzed the council boundary change proposed by the Applicants and in doing so, duly considered all the factors listed under Admin. Code § 95.07 and all relevant material submitted by the district councils or any other person or group having an interest in the proposed boundary change; and

WHEREAS, the Council further finds that the Application describes the existing and proposed boundary and states as well a rationale for the requested boundary change including why the change will improve engagement and representation for the residents in the area affected by the change; and

WHEREAS, the Council further finds that Applicants, in accordance with Admin. Code § 95.03.A.2, have notified all properties in the area of the proposed boundary change and held a public meeting on July 22, 2019 where the change was considered with input taken from all interested parties; and

WHEREAS, the Council further finds and accepts the report and recommendation to adopt the boundary change as proposed by the Applicants as set forth in the January 8, 2020 staff report; and

WHEREAS, following a public hearing before the City Council conducted on February 19, 2020, at which all interested parties were given an opportunity to be heard, and having considered all the facts, recommendations, and testimony concerning the said petition the Council of the City of Saint Paul; DOES

HEREBY RESOLVE: that the boundary between District 9 and District 17 shall be changed according to the map attached to this Resolution as Exhibit 1, and

BE IT FURTHER RESOLVED, that the Council incorporates by reference the findings of PED staff, as substantially set forth in the PED staff report dated January 8, 2020, as its formal statement of reasons to support the boundary change; and

BE IT FINALLY RESOLVED, that this boundary change shall immediately take effect upon passage and approval of this Resolution.
