Authorizing the applications to the Department of Employment and Economic Development for contamination investigation and cleanup grants, and to the Metropolitan Council for tax base revitalization grants for the Chittenden and Eastman, Starky, Rayette, Schmidt Brewery Phase II, 2318 Marshall, and the Hamm's Brewery sites.

WHEREAS, the City has identified environmental investigation and clean-up projects within the City that meet the purposes and criteria of the Contamination Cleanup Grant Program of the Department of Employment and Economic Development and the Tax Base Revitalization Account Grant Program of the Metropolitan Council; and
WHEREAS, the City of Saint Paul, Minnesota is a participant in the Livable Communities Act's Housing Incentives Program for 2011 as determined by the Metropolitan Council, and is therefore eligible to make application for funds under its Tax Base Revitalization Account; and
WHEREAS, the City finds that the required contamination cleanup will not occur through private or other public investment within the reasonably foreseeable future without funding from the Contamination Cleanup Grant Program and/or the Tax Base Revitalization Account Grant Program; and
WHEREAS, the City represents that it has undertaken reasonable and good faith efforts to procure funding for the activities for which Tax Base Revitalization Account grant funding is sought but was not able to find or secure from other sources funding that is necessary for cleanup completion and states that this representation is based on the following reasons and supporting facts:
• State reductions in Local Government Aid leave the City of Saint Paul with no general fund resources to invest in remediation activities, and
• The expiration of some tax increment districts and the depletion of various development accounts leave the Housing and Redevelopment Authority of the City of Saint Paul with no development resources to invest in these remediation activities.
WHEREAS, the City has the institutional, managerial, and financial capability to ensure adequate project and grant administration; and
WHEREAS, the City certifies that it will comply with all applicable laws and regulations as stated in the contract grant agreements;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Saint Paul, Minnesota hereby approves the contamination investigation and cleanup grant applications submitted to the Metropolitan Council on November 1, 2011; and
BE IT FURTHER RESOLVED, that the City of Saint Paul, Minnesota agrees to act as legal sponsor for the projects contained in the cleanup grant applications submitted to the Department of Employment and Economic Development and the Metropolitan Council on November 1, 2011, and that the Director of the Department of Planning and Economic Development is hereby authorized to apply to these agencies for funding of these projects on behalf of the Chittenden and Eastman, Starky, Rayette, Schmidt Brewery Phase II, 2318 Marshall, and the Hamm's Brewery sites; and
BE IT FURTHER RESOLVED, that the sources and amounts of the local match identified in the applications are committed to the projects identified; and
BE IT FURTHER RESOLVED, the City certifies that it has not violated any Federal, State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest, or other unlawful or corrupt practice and that it will comply with all applicable laws and regulations as stated in the contract agreements; and
BE IT FURTHER RESOLVED, that if the City is awarded a grant by the Department of Employment and Economic Development and/or the Metropolitan Council, the City of Saint Paul will be the grantee and legal sponsor and its Department of Planning and Economic Development will act as recipient and administrator of the grant funds expended for the project contained in the Contamination Investigation and Cleanup grants and the Tax Base Revitalization Account grants submitted on November 1, 2011;
NOW THEREFORE BE IT FINALLY RESOLVED, that the Mayor and City Clerk of the City of Saint Paul are hereby authorized to execute such agreements as are necessary to implement the projects on behalf of the applicant.
