Requesting approval of a Third Amendment to the lease between the City and Board of Water Commissioners for the Police Department's use of Board-owned property for the K-9 facility and training.
Body
WHEREAS, the City of Saint Paul (“City”) entered into a Lease Agreement with the Board of Water Commissioners of the City of Saint Paul (“Board”) dated June 27, 1978, authorizing use of Board-owned property located at the McCarrons Water Treatment Plant for the construction and maintenance of a canine training and kennel facility for the Saint Paul Police Department; and
 
WHEREAS, the Lease Agreement has been previously amended and extended on several occasions, most recently by a Second Amended Lease dated November 9, 2020, and a Fourth Rider dated May 10, 2022, which extended the term through June 27, 2053 and authorized certain canine facility improvements; and 
 
WHEREAS, the City has submitted plans requesting approval to expand parking areas and construct a retaining wall at the canine facility to improve functionality, circulation, and safety; and 
 
WHEREAS, the construction plans for such improvements have been reviewed by Saint Paul Regional Water Services staff and found to be consistent with the intended use of the leased premises, subject to compliance with all applicable permits, laws, and environmental requirements, including considerations for tree protection and water resource impacts; and 
 
WHEREAS, the Board deemed it appropriate and in the public interest to approve the proposed improvements and to formally authorize execution of a Third Amended Lease Agreement ("Third Amendment"), attached hereto as Exhibit A, as adopted by the Board on October 21, 2025 in its Resolution No. 25-1644, attached hereto as Exhibit B; and
 
WHEREAS, the City also desires City Council approval of said Third Amendment; now, therefore, be it
 
RESOLVED, that the Saint Paul City Council hereby approves the Third Amendment between the Board and City in a form and content substantially as set forth in Exhibit A attached hereto, and further authorizes and directs the proper city officials to execute said Third Amendment and any related documents; and be it finally
 
RESOLVED, that all terms, covenants, and conditions of the existing Lease Agreement, as previously amended, shall remain in full force and effect except as specifically modified by this Third Amendment.
