Title

Authorizing the City to enter into a Joint Powers Agreement with the State of Minnesota to participate in the Multijurisdictional Disparity Study.

Body

Authorizing the appropriate city officials to enter into the Joint Powers Agreement (“JPA”) and execute all documents necessary for participation in the Joint Disparity Study with the State of Minnesota, acting through its Commissioner of Administration.

 

WHEREAS, Minnesota Statute §471.579, subdivision 10, allows two or more governmental units, by agreement entered into through action of their governing bodies, to jointly or cooperatively exercise any power common to the contracting parties; and

 

WHEREAS, the City of Saint Paul and the Saint Paul Housing and Redevelopment Authority (“the City and its HRA”) wish to partner with the State of Minnesota in conducting a joint disparity study; and

 

WHEREAS, the State of Minnesota (“State”) is a governmental entity which has a contractual agreement with the disparity study consultant providing services yielding a disparity study for the City and its HRA; and

 

WHEREAS, the State has established a favorable price for a multi-jurisdictional disparity study and in order to receive an updated disparity study from the established contract, the City and its HRA would need to partner with the State through the disparity study Joint Powers Agreement; and

 

WHEREAS, the draft JPA includes an indemnification agreement whereby the City is responsible to save, indemnify, and hold harmless the State from the City’s own actions; and

 

WHEREAS, the City Council finds that the joint exercise of the disparity study through partnership with the State would allow the City and its HRA to receive a completed, recent disparity study, and at a favorable price; now, therefore, be it

 

RESOLVED, that the Council authorizes the appropriate city officials to enter into the attached JPA with an indemnification clause and all documents necessary for participation in the joint disparity study with the State.
