Title

Pertaining to a Joint Powers Agreement between the Board of Water Commissioners and Dakota County for Dakota County Project No. 63-033 and No. 04-018.

 

Body

WHEREAS, under Minnesota Statues sections 162.17, subd. 1 and 471.59, subd. 1, two governmental units may enter into an agreement to cooperatively exercise any power common to the contracting parties, and one of the participating governmental units may exercise one of its powers on behalf of the other governmental units; and

                     

WHEREAS, Dakota County and the Board are proceeding with County Projects 63-033 and 04-018; and

 

WHEREAS, County Project 63-033 will include reconstructing County State Aid Highway 63 (Delaware Avenue) between Marie Avenue and County Road 149 (Dodd Avenue), and includes reconstruction of 1.53 miles of roadway including new pedestrian facilities, retaining wall, intersection safety improvements and utility replacement and relocations; and

 

WHEREAS, County Project 04-018 will include resurfacing the pavement of County Road 4 (Butler Avenue) between County Road 149 (Butler Avenue) and Manomin Avenue, and includes construction of 0.23 miles of pedestrian trail and sidewalk, 0.23 miles of pavement overlay, and utility replacement and relocations; and

 

WHEREAS, the Board desires to repair watermain infrastructure within the project limits of County Project 63-033 and 04-018; and

 

WHEREAS, the County and the Board mutually desire to partner with one another in exercising their joint powers to complete final design, construction administration, and maintenance of the Project, as well as to determine each parties’ respective shares of project costs; and

 

WHEREAS, the County and the Board will jointly participate in the costs of said final design engineering, construction administration, and maintenance; now, therefore, be it

 

RESOLVED, that the Board of Water Commissioners of the City of Saint Paul does hereby approve the draft Joint Powers Agreement between the Board and Dakota County for Dakota County Project No.  63-033 and 04-018, and that the proper officers are hereby authorized and directed to finalize and execute said Joint Powers Agreement on behalf of the Board following approval of the assistant city attorney.
