Approving the application for Liquor On Sale, Liquor On Sale - Sunday, Liquor Outdoor Service Area (Sidewalk), Entertainment (B), and Gambling Location licenses (License ID #DSIBLLIQ-000621-2026) now held by Latino Economic Development Center d/b/a Plaza del Sol for the premises located at 990 Payne Ave.

WHEREAS, Latino Economic Development Center d/b/a Plaza Del Sol ("Applicant") applied for Liquor On Sale, Liquor On Sale - Sunday, Liquor Outdoor Service Area (Sidewalk), Entertainment (B), and Gambling Location licenses (License ID #DSIBLLIQ-000621-2026) for the premises located at 990 Payne Ave.; and
WHEREAS, On May 22, 2026, the Department of Safety and Inspections sent out the required License Application Notification with a response date of June 6, 2026; and
WHEREAS, On May 20, 2026, the Applicant signed a License Condition Affidavit agreeing to follow all license conditions; and
WHEREAS, The licenses shall be issued only after the work on the licensed premises is completed and the building official determines that all of the requirements are complied with; and
WHEREAS, The Council finds that the application is in order and there are no grounds to deny approval of the licenses, upon the completion of work on the licensed premises and required approval from the building official; now, therefore, be it
RESOLVED, That the application for Liquor On Sale, Liquor On Sale - Sunday, Liquor Outdoor Service Area (Sidewalk), Entertainment (B), and Gambling Location licenses (License ID #DSIBLLIQ-000621-2026) is hereby approved and the licenses shall be issued to Latino Economic Development Center d/b/a Plaza del Sol for the premises located at 990 Payne Ave., once the building official issues final approval of the work at the licensed premises, with the following license conditions:
1. License holder acknowledges that the liquor on sale license is issued to them as the sole operator for the sale, service and consumption of alcohol within a compact and contiguous space as shown on the approved liquor service area plan on file with the Department of Safety and Inspections (DSI), and that the license holder is responsible for all liquor service operations within the licensed premises inclusive of but not limited to food hall and entertainment space.
2. License holder acknowledges that the sale, service, display and/or consumption of alcohol may only be conducted when a minimum of one licensed restaurant is operating and actively providing food service to patrons and guests within the approved liquor service area.
3. License holder acknowledges restaurant operations and food service must cease at 12:00 a.m. midnight daily and that the sale, service, display and/or consumption of all alcohol must end at 12:00 a.m. midnight. All patrons and customers must vacate the premises by 12:30 a.m. each day of the week.
4. License holder agrees to limit the placement of tables and chairs on the public sidewalk to the area and number of seats shown on the approved sidewalk seating plan on file with DSI and the and the Public Works Department (PW).
5. Each year prior to the placement of tables and chairs in the public right-of-way (sidewalk), the license holder agrees to obtain a new Obstruction Permit from PW. License holder agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that tables and chairs may not be placed in the public right-of-way before or after the effective and expiration dates, and that failure to comply with this condition may result in adverse action being taken against all of their licenses.
6. License holder agrees to take appropriate actions to ensure that the sale, display, and/or consumption of alcoholic beverages is contained within the defined outdoor liquor service area as per the approved plan on file with DSI.
