Approving the re-issuance of the City Contractor - Fence license to Patrick D. Quinn, d/b/a Northland Fence, and waiving the $500.00 matrix penalty previously imposed.
Body
WHEREAS, Patrick D. Quinn d/b/a Northland Fence ("Applicant") applied  for a City Contractor-Fence license for the premises located at 1020 Bridge Street, Stillwater, MN, 55126; and
 
WHEREAS, the City Contractor-Fence license held by Applicant (License ID #20110002653) for the City of Saint Paul was the subject of a Notice of Intent to Suspend License dated January 28, 2013, stating the Applicant had failed to pay delinquent license and late fees of $267.00 and submit the following information:  1) a current certificate of General Liability insurance with a 30-day notice of cancellation and naming the City of Saint Paul as an additional insured; 2) a $2,500.00 License, Permit and Performance Bond and 3) a completed Certificate of Compliance Minnesota Workers' Compensation Law form; and
 
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and   
 
WHEREAS, the Applicant did not respond to the Notice of Intent to Suspend License to pay the delinquent license and late fees and submit required information or request a hearing; and  
 
WHEREAS, a resolution was submitted to the Consent Agenda and on February 20, 2013, and City Council approved the license suspension and imposition of the $500.00 matrix penalty (RES #13-270); and
WHEREAS,  on June 17, 2014, the Applicant contacted the Department of Safety and Inspections regarding his City Contractor-Fence license and was informed that it was suspended and he would need to pay the $500.00 matrix penalty before he could obtain a new license; and
WHEREAS, the Applicant informed DSI they moved their offices previously located at 3601-85th Avenue, North #6, Brooklyn Park, MN, so he never received any of the  delinquent notices or the Notice of Intent to Suspend License;
 
WHEREAS, the licensee was not aware he needed to renew the City Contractor-Fence license every year whether or not they worked in the City of Saint Paul during that year, and explained that they had not done any business in Saint Paul in 2013; now therefore be it
RESOLVED, that the Saint Paul City Council has determined that it would be appropriate to allow the Department of Safety and Inspections to re-issue the Applicant his previous City Contractor-Fence license (License ID #20110002653) for the new  premises located at 1020 Bridge Street in Stillwater, MN; and be it
FURTHER RESOLVED, due to Applicant's reasonable explanation for his failure to respond to the previous delinquency notices, the City Council also waives the $500.00 penalty previously imposed.
