Approving adverse action against the Liquor Off Sale & Tobacco Shop license held by Mounds Liquor Corp d/b/a Mounds Liquor (License ID #20160003381) for the premises located at 1047 Hudson Road.

WHEREAS, the Liquor Off Sale & Tobacco Shop license held by Mounds Liquor Corp d/b/a Mounds Liquor (License ID #20160003381) for the premises located at 1047 Hudson Road, in Saint Paul was the subject of a Notice of Intent to Revoke License (“Notice”) dated April 19, 2024; and 

 

WHEREAS, the Notice stated that on December 6, 2023, the Department of Safety and Inspections (“Department”) informed the licensee they failed to renew their license. The licensee also failed to provide any proof of renewal and proof of liquor liability insurance;

 

WHEREAS, the Notice stated that the licensee had been notified on multiple occasions that their license was a delinquent license. The licensee was also notified that they owed money for their license. The licensee failed to respond to emails and letters attempted by the Department of Safety and Inspections. The Department of Safety and Inspection recommended a revocation of the Liquor Off Sale & Tobacco Shop license application based on violation of the Saint Paul Legislative Code §310.02 (2)(a), §310.05, §409.065 and Minnesota Statute §340A.409;

 

WHEREAS, Saint Paul Legislative Code §310.02(2)(a) states no applicant will be granted a license or a renewal of a license required by the Saint Paul Legislative Code unless, in addition to any other requirements, rules or ordinances heretofore or hereafter required, the director determines that said applicant had paid all taxes, real or personal, before said taxes become delinquent, on any property, real or personal, situated within the City of Saint Paul and used in connection with the business operated under said license;

 

WHEREAS, Saint Paul Legislative Code §310.05 requires that no licensee may continue to  operate or perform the licensed activity after as a result of failing to file and maintain insurance policies;

 

WHEREAS, Saint Paul Legislative Code §409.065 requires that no license under this chapter may be issued, maintained or renewed unless the licensee or applicant therefore complies with the insurance requirements imposed by Minn Stat. § 340A.409; and

 

WHEREAS, Minnesota Statute §340A.409 states no retail license may be issued, maintained or renewed unless the applicant demonstrates proof of financial responsibility;

 

WHEREAS, the Department of Safety and Inspections recommended a revocation of the license application; and

 

WHEREAS, the Notice gave the licensee until April 29, 2024, to: 1) not contest the proposed adverse action; 2) request a hearing before Saint Paul City Council; or 3) Request an Administrative Hearing; and

 

 

WHEREAS, your license expired on December 6, 2023, and you have failed to renew your license;

 

WHEREAS, you have also failed to provide any proof that you renewed or obtained a new liquor liability insurance policy; 

 

WHEREAS, on January 31, 2024, the Department emailed you at mvang77@hotmail.com <mailto:mvang77@hotmail.com> letting you know that your licenses were delinquent.  You did not respond to that email; 

 

WHEREAS, on January 31, 2024, DSI Inspector Luis Sanchez-Panadero visited the Licensed Premises and documented that the property was vacant. It appears that you have closed the business; 

 

WHEREAS, on January 31, 2024, a Renewal invoice was sent to the licensee requesting payment upon receipt. As of this date the licensee has not renewed their license;

 

 

WHEREAS, on February 15, 2024, the Department again emailed you at mvang77@hotmail.com <mailto:mvang77@hotmail.com> stating that your licenses were delinquent since you still owed money for the licenses. You did not respond to that email;

 

 

WHEREAS, finally, on March 7, 2024, a fax from the Minnesota Department of Revenue was sent to the Department of Safety Inspections. This fax states that you have an overdue debt/or have not filed your tax returns; and

 

 

WHEREAS, as of this date your license has not been renewed;

 

 

WHEREAS, the Notice stated if the licensee failed to contest to the revocation of the license application, that the matter would be placed on the City Council Agenda to impose the recommended penalty; now, therefore, be it

 

 

RESOLVED, the Liquor Off Sale & Tobacco Shop license held by Mounds Liquor Corp d/b/a Mounds Liquor (License ID #20160003381) for the premises located at 1047 Hudson Road, in Saint Paul is hereby revoked.
