Approving the partial release of utility easements within vacated Langford Park (Street) adjacent to 2180 Knapp Street for the Saint Paul Public School District.

 

Body

WHEREAS, in 1974 the Saint Paul Public School District ("SPPS") condemned and vacated Langford Park, a street needed in connection with the acquisition of land for the St. Anthony Park Elementary School (2180 Knapp Street), as documented in Ramsey County records (Document Number 1892130, Court File Number 377501, and described as:

 

"That part of the traveled roadway designated as Langford Park lying adjacent to Block 36, St. Anthony Park, Minnesota, and between the northerly line of said Block 36 extended westerly to Langford Park proper and a line drawn parallel to and 66 feet northwesterly of the northerly line of Block 42, St. Anthony Park, Minnesota,"

 

and also depicted in Exhibit A1 attached hereto; and

 

WHEREAS, the City of Saint Paul ("City") received a request from SPPS for the partial release of existing utility easements within said condemned and vacated street belonging to the Board of Water Commissioners on behalf of St. Paul Regional Water Services ("SPRWS") for a water main, and the City on behalf of the Department of Public Works ("PW") for sanitary and storm sewers; and

 

WHEREAS, SPRWS and PW have determined that their easement rights may be waived, released and terminated within a designated area of said condemned and vacated street; as depicted in Exhibit A2 attached hereto; now, therefore be it

 

RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf of the City of Saint Paul - Public Works and the Saint Paul Regional Water Services and made a part hereof by this reference and filed in the Office of Financial Services Real Estate Section, the City, for itself and on behalf of said utilities, hereby waives, releases and terminates said utility easement rights within the area depicted in Exhibit A2; and be it further

 

RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee from SPPS, the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificates of Intended Non-Use referenced in this resolution.
