Title

Amending the 2015 budget in the amount of $14,000,000 to accept certain grants from the State of Minnesota for the Renovation and Expansion of the Minnesota Children’s Museum; and approving and authorizing execution of State Grant Agreement(s) and related documents, Amended and Restated Lease/Use Agreement and related documents, and a STAR Loan Agreement and related documents (Ward 2, District 17).

 

Body

WHEREAS, in 2014 the Minnesota Legislature approved a GO Bond Grant of $6,515,000 and General Funds Grant of $7,485,000 (collectively, the “Grant”) for the Renovation  and Expansion of the Minnesota Children’s Museum in downtown Saint Paul (“Project”), by Chapter 294, Article 1, Section 21, Subd. 17 and by Chapter 295, Section 10, Subd. 12 as amended by MN Laws 2015, Chapter 2, Article 4, Section 3; and

 

WHEREAS, City of Saint Paul staff has negotiated the terms and conditions of an Amended and Restated Lease/Use Agreement with Minnesota Children’s Museum and other related documents (collectively, the “Lease Documents”) and one or more Grant Agreements for construction, and other related documents with the Department of Employment and Economic Development for the State of Minnesota (collectively the “State Construction Grant Documents”); and

 

WHEREAS, the Mayor, pursuant to Section 10.07.1 of the Charter of the City of Saint Paul, does hereby certify that $14,000,000 in funds are available for appropriation in excess of those estimated in the 2015 budget and recommends the changes to the 2015 budget identified on Attachment A; and

 

WHEREAS, the City Council has approved $1,010,000 in Cultural STAR funding for the Minnesota Children’s Museum in RES #15-1017 for use in the Project and City staff has negotiated terms and conditions of a Cultural STAR Capital Project Loan Agreement and other related documents (collectively, the “STAR Agreements”); and

 

WHEREAS, a public hearing on this resolution was held before the City Council on this date hereof, October 7, 2015, and the City Council finds a public purpose for the actions taken in this resolution.

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Saint Paul hereby accepts the Grant from the State of Minnesota, approves the use and operation of the Minnesota Children’s Museum for purposes of the State Program as described in the State Construction Grant Documents, approves the Lease Documents, the State Construction Grant Documents and the STAR Agreements and the proper officials of the City are hereby authorized and directed to execute the Lease Documents, the State Construction Grant Documents and the STAR Agreements on behalf of the City.

 

BE IT FURTHER RESOLVED, that the City Council approves the changes to the 2015 budget as identified in Attachment A.

 

BE IT FURTHER RESOLVED, that City staff and legal counsel for the City are further directed and authorized to take all actions necessary to implement this Resolution and the City’s Director of Department of Planning and Economic Development is authorized to execute such documents, consents and instruments in connection therewith including without limitation annual approvals of operating budgets of the Project’s operator and other actions required by the State Construction Grant Documents.
