Approving the application with conditions, per the Legislative Hearing Officer, for Hour Glass Café LLC, d/b/a Hour Glass Bar & Café (License ID #20230000657), for Liquor On Sale 100 seats or less and Liquor On Sale - Sunday licenses, located 560 7th St W.

WHEREAS, Hour Glass Café LLC, d/b/a Hour Glass Bar & Café (License ID #20230000657), located at 560 7th St W, has applied for Class N licenses for Liquor On Sale 100 seats or less and Liquor On Sale - Sunday licenses; and
WHEREAS, the initial application was made with the name Trapped Puzzle Rooms Inc, d/b/a The Lodge of Lazarus Crowe; and
WHEREAS, the applicant notified the Fort Road Federation - District Council 9 on 4/21/2023, prior to their application; and
WHEREAS, a notification regarding the license application was sent from the Department of Safety and Inspections to the affected neighborhood for the period of August 22, 2023, to September 6, 2023; and
WHEREAS, during the notification period, objections were received which triggered the hearing and a hearing was held on September 11, 2023; and
WHEREAS, the objections were related to traffic, parking, and nuisance activities; and
WHEREAS, in response to the concerns raised, the licensee has agreed to work with the city to comply with the necessary requirements to minimize nuisance activities that would disturb the surrounding residential neighborhood; and
WHEREAS, after conducting the hearing and considering the testimonies and evidence, the Legislative Hearing Officer recommends that the application for Hour Glass Café LLC, d/b/a Hour Glass Bar & Café(License ID #20230000657), located at 560 7th St W, be approved with the following conditions:
1. Licensee agrees to operate the establishment in compliance with Section 409.02 of the City of Saint Paul Legislative Code as a "Restaurant".
2. Licensee agrees to close the establishment at 12:00 a.m. midnight. All patron/customers shall vacate the premises by 12:30 a.m. each day of the week as per Section 409.02 of the City of Saint Paul Legislative Code.
3. Signage and staffing will be used to prevent alcohol from being removed from the licensed premises or brought into the licensed premises. This includes ensuring alcohol is not taken from the license premise into the adjacent Trapped Puzzle Rooms portion of the building, as well as all common spaces.
4. All doors to the establishment shall be closed at all times.
5. The licensee acknowledges and agrees that they are fully responsible and accountable for the management of the licensed premise (as defined in the approved floor plan), including all individuals and/or groups within and / or on the premise, to the extent required by Saint Paul Code of Ordinances.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned agreed-upon conditions and finds that the license conditions are reasonable, and the application is in order and there are no grounds to deny the approval of the licenses.
The conditions affidavit was signed on September 8, 2023 and submitted on September 11, 2023.
