Title

Waiving the 45-day notice requirement to approve Wine On Sale, Malt On Sale (Strong), and Sidewalk Café licenses, and the addition of a new owner to the existing ownership group for The Green Mill Inn LLC, d/b/a Twisted Fork Grille (License ID #20130003649) at 1342 Grand Avenue.

 

Body

WHEREAS, The Green Mill Inn LLC d/b/a Twisted Fork Grille (License ID #20130003649) for the premises located at 1342 Grand Avenue in Saint Paul applied for Wine On Sale, Malt On Sale (Strong) and Sidewalk Café licenses; and

 

WHEREAS, the licensee also applied for a 45-day waiver to allow the addition of a new owner to the existing ownership group; and

 

WHEREAS, DSI received a letter from Macalester-Groveland Community Council approving the 45-day waiver and had no objections to the issuance of the Wine On Sale, Malt On Sale (Strong) and Sidewalk Café licenses and addition of a new owner to the existing ownership group; and

 

WHEREAS, the Council finds that the application are in order and there are no grounds for denial of the Wine On Sale, Malt On Sale (Strong) and Sidewalk Café licenses and addition of a new owner to the existing ownership group; now, therefore, be it,

 

RESOLVED, the addition of a new owner to the existing ownership group is hereby granted.

 

FURTHER RESOLVED, the Wine On Sale, Malt On Sale (Strong) and Sidewalk Café licenses (License ID #20130003649) are hereby granted for the premises located at 1342 Grand Avenue with the following conditions:

 

1.      Per City of Saint Paul Legislative Code 409.15 - The sale of Wine On Sale and Malt On Sale (Strong) will take place only in conjunction with the sale and service of food (Menu item only).  Copies of gross/revenue receipts (from the sales of food, wine, and beer) showing at least sixty (60) percent attributable to the sale of food shall be made available for review upon request of the director of the Department of Safety and Inspections (DSI) or his/her designated representative.

 

2.      The service counter seating shall be limited to a maximum of 10 seats.

 

3.      A Designated Drive Program shall continue to be promoted within the restaurant.

 

4.      No dumping of glass and bottles into dumpsters by Green Mill cleanup staff before 7:00 a.m. and after 10:00 p.m.

 

5.      No pickup of trash and/or recyclables before 7:00 a.m. on weekdays or 9:00 a.m. on weekends.

 

6.      Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e., sidewalk), the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works.  Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that a failure to comply with this condition will result in adverse action being taken against all of their licenses.

 

7.      No liquor sales and/or service is allowed on a public sidewalk without prior approval and additional licensing from DSI.

 

8.   Sidewalk seating is approved for a maximum of fourteen (14) seats.
