Title

Amending Section 86.01(a) of the Saint Paul Administrative Code to Authorize up to Three (3) Assistants to the Mayor to Execute Certain Contracts Made in the Name of the City of Saint Paul and Authorized by the City Council and Further Amending Section 86.01 (a) to Increase the Dollar Value Amount for Contracts Executed by Designees.

Body 

WHEREAS, An Ordinance amending the Saint Paul Administrative Code, Chapter 86.01(a), pertaining to the authorization of the mayor or the executive assistant to the mayor to execute certain contracts made in the name of the City of Saint Paul and authorized by the city council, is necessary to facilitate the timely execution of city business; and

 

WHEREAS, Section 86.01(a) of the Administrative Code only permits the mayor and the executive assistant to the mayor to execute certain contracts made in the name of the City of Saint Paul and authorized by the city council; and 

 

WHEREAS, The Mayor of the City of Saint Paul has determined that it is necessary to designate up to three (3) assistants to the mayor, pursuant to Section 86.01(a), with the same authority to execute contracts that the mayor and executive assistant to the mayor have so that each assistant to the mayor can focus on a smaller number of projects, and so that the business of the city is not unnecessarily delayed; and

 

WHEREAS, Section 86.01(a) of the Administrative Code authorizes designees of the Mayor to execute contracts with a maximum dollar value of $50,000, and the Mayor desires to increase the dollar value limit for designees to $175,000; now therefore

 

Section 1.

 

The City Council of the City of Saint Paul Does Ordain: 

 

Chapter 86.01 of the Saint Paul Administrative Code is hereby amended as follows:

Sec. 86.01. - City contracts, execution.

 

(a) Except as specified in subsection (c) below or otherwise provided by law, all contracts made in the name of the City of Saint Paul and authorized by the city council shall be executed on behalf of the city by the mayor or executive assistant to the mayor, or such designees as the mayor may authorize by administrative order filed with the city clerk; provided, that such authorization shall be extended to such designees only for contracts of a stated dollar value of fifty thousand dollars ($50,000.00) one hundred seventy-five thousand dollars ($175,000.00) or less, and the director of the office of financial services.  The mayor may authorize by administrative order filed with the city clerk up to three (3) assistants to the mayor (as defined in Section 2.02(F) of the Saint Paul Administrative Code) to execute any of the contracts described in this subsection (a) that the mayor or executive assistant to the mayor are authorized to execute.  The foregoing limitations do not apply to purchase order contracts processed by the contract and analysis services section and which may be signed by the director of the office of financial services regardless of the dollar amounts of such purchase order contracts. The director of the office of financial services may delegate the authority to sign contracts to any employee.

 

(b) The director of the office of financial services or designee may execute contracts in an amount of two thousand five hundred dollars ($2,500.00) or less, including all applicable taxes, shipping and handling charges, and no other signatures shall be required to bind the city. Such contracts shall be on such a form as the director shall provide, and such contracts shall be made in such a manner as the director shall authorize. The director shall regularly monitor such contracts of two thousand five hundred dollars ($2,500.00) or less to assure they are in compliance with this chapter.

 

(c)  When the value of the contract is less than fifty thousand dollars ($50,000.00) and such contract is for the purchase of goods, the only signature required shall be that of the contract and analysis services manager or designee.

 

(d)  Any management agreement for park lands and/or recreation facilities which will be for a period of more than one (1) year shall require approval by the council following a public hearing before the park commission, unless such management agreement is controlled by the provisions of Saint Paul Administrative Chapter 85, in which case the provisions therein shall control.

 

Section 2. 

 

This Ordinance shall take effect and be in force thirty (30) days following its passage, approval and publication.
