TITLE

Amending Chapter 66 of the Legislative Code to correct a scrivener’s error related to allowing additional lot coverage for providing functional green roof space.

BODY

WHEREAS, the Saint Paul Zoning Code, found in chapters 60 through 69 of the Saint Paul Legislative Code, is established to regulate the location, construction, reconstruction, alteration and use of buildings, structures and land; and

WHEREAS, Section 61.801(a) of the Saint Paul Zoning Code calls for periodic review of said code to reflect current city policies and bring the code up to date; and

WHEREAS, the City of Saint Paul has established zoning regulations related to Ford (F) Districts in Zoning Code Chapter 66; and

WHEREAS, the Ford Site Zoning and Public Realm Master Plan governs development in the Highland Bridge site; and

WHEREAS, a scrivener’s error was discovered in the Zoning Code when comparing a duplicative standard established in the Ford Site Zoning and Public Realm Master Plan; and

WHEREAS, the Planning Commission, on February 6, 2026 released a draft of the proposed amendment for public review and set a public hearing date of March 20, 2026; and

WHEREAS, a public hearing notice was published in the Pioneer Press on March 10, 2026 pursuant to Minnesota Statutes Section 462.357, Subd. 3 and sent to the early notification system list on February 10, 2026; and

WHEREAS, a public hearing on the proposed amendment was conducted by the Planning Commission on March 20, 2026, at which all persons present were allowed to testify; and

WHEREAS, the written record was left open until March 23, 2026, at 4:30 p.m.; and

WHEREAS, at the March 20, 2026 public hearing and during the comment period no persons spoke or submitted letters; and

WHEREAS, a public hearing before the City Council, on May 6, 2026, having been duly conducted at which all interested parties were given an opportunity to be heard, and having considered all the testimony and recommendations concerning the proposed text amendment, including the Planning Commission's minutes, which the Council finds persuasive and thus hereby incorporates by reference into this ordinance for the specific purpose of articulating the Council's reasons and rationale for enacting the recommended amendment as set forth below, in addition to any other reasons the Council might articulate on the record in adopting these amendments, the Council, having considered all the facts and recommendations concerning the proposed zoning amendment and pursuant to the authority granted by and in accordance with the procedures set forth in Minnesota Statutes 462.357 states as follows:

 

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

Legislative Code Chapter 66. - Zoning Code-Zoning District Uses, Density and Dimensional Standards is hereby amended as follows:

ARTICLE IX. - 66.900. Ford Districts

Division 3. - 66.930. Ford District Dimensional Standards

Sec. 66.931. - Ford district dimensional standards table.

(f)                     Portions of a parking structure that are less than one (1) story above grade, as defined in Section 60.208, and serve as amenity space shall be excluded from lot coverage by buildings in lot coverage calculations. A building that provides Functional Green Roof Area that faces the right-of-way, civic areas, central stormwater feature, and/or city parks as specified in the Ford Site Zoning and Public Realm Master Plan, can receive a one (1) percent lot coverage bonus for every one (1) percent of Functional Green Roof provided, up to a five (5)ten (10) percent lot coverage bonus.
