Title

First Making finding on the appealed substantial abatement ordered for 1356 REANEY AVENUE in Council File RLH RR 23-23.  (Amend to grant 180 days)

 

Body

WHEREAS, the City Council adopted RLH RR 23-23 on September 13, 2023 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 1356 Reaney Avenue; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on March 12, March 26, April 9, April 23, and May 14, 2024, to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions not abated, but will recommend the CIty Council grant an additional 180 days, pending posting of a new $5,000 performance deposit  forthcoming; and

 

WHEREAS, the Legislative Hearing Officer recommends the $5,000 performance deposit posted in order to receive the original grant of time September 13, 2023, as the Building Official made the determination there was 0% progress achieved in the original 180-day grant of time; and

 

RESOLVED, that at the conclusion of the additional 180-day grant of time, the Council will receive a report from the Legislative Hearing Officer with findings on the status of the nuisance abatement; And Be It Further

 

RESOLVED, that a Legislative Hearing is scheduled for November 12, 2024 at which owners, interested parties and Department of Safety and Inspection staff will present information on the current building conditions and progress toward abatement of the dangerous/nuisance conditions and the resulting findings will be presented to the City Council at a public hearing on December 4, 2024 for its consideration; And, Be It Further

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is not abated but will grant an additional 180 days to complete the nuisance abatement and forfeit the original $5,000 performance deposit  forthcoming.
