Approving the application for change of ownership to the Gas Station and Tobacco Shop license now held by Town Mart Inc d/b/a Town Mart (License ID #20250000798) for the premises located at 1980 Stillwater Ave.

WHEREAS, on May 2, 2025, Town Mart Inc d/b/a Town Mart (License ID #20250000798) applied for a change of ownership to the Gas Station and Tobacco Shop license for the premises 1980 Stillwater Ave; and
WHEREAS, on July 2, 2025, the Department of Safety and Inspections sent out the required License Application Notification; with a response date of July 17, 2025; and
WHEREAS, in response to the notification no objections or comments were received; and
WHEREAS, the Council finds that the application is in order and there are no grounds to deny approval of the license; now, therefore, be it,
RESOLVED, the change of ownership for the Gas Station and Tobacco Shop license is hereby approved and issued to Town Mart Inc d/b/a Town Mart (License ID #20250000798) for the premises located at 1980 Stillwater Ave., with the following licensing conditions:
RECOMMENDED LICENSE CONDITIONS:
01/24/1992 Zoning File #91-294 Special Condition Use Permit to allow gasoline sale one hour earlier at 6:00 a.m. on property located at 1980 Stillwater Avenue, approved with the following conditions:
1. The sale of gasoline is permitted between the hours of 6:00 a.m. and 11:00 p.m. Per license requirement the sale of gasoline is permitted between the hours of 6:00 a.m. and 10:00 p.m. from Sunday through Thursday, 6:00 a.m. and 11:00 p.m., Friday and Saturday.
2. A four to five foot wide planting area shall be provided between the Stillwater Avenue driveways. The existing planting area shall be planted and maintained with shrubs, flowers, or other plant materials not including grass.
3. The driveway from Iroquois Avenue shall remain one way going west.
4. No bulk fuel deliveries between the hours of 11:00 p.m. through 6:00 a.m.
5. The licensee shall pick up trash, litter, and empty bottles and/or cans in the immediate vicinity of the licensed business, whether on public or private property daily.
