Approving a waiver of the 45-day waiting period in order to issue a Liquor Outdoor Service Area (Sidewalk) license with conditions to GMP Rochester LLC, d/b/a Sweet Peas Public House (License ID #20160002119) at 472 Snelling Avenue South.

WHEREAS, GMP Rochester LLC d/b/a Sweet Peas Public House (License ID #20160002119) applied for a Liquor Outdoor Service Area (Sidewalk) license for the premises located at 472 Snelling Avenue South in Saint Paul; and
WHEREAS, the licensee also applied for a Liquor On Sale 100 seats or less; Liquor On Sale- Sunday; a Liquor On sale - 2AM Closing and an Entertainment A license; and
WHEREAS, the licensee submitted a “Good Faith” letter indicating an effort to obtain the required number of petition signatures; and
WHEREAS, the licensee was able to obtain twenty (20) out of a possible twenty-five (25) petition signatures for eighty percent (80%) support of the issuance of a Liquor-Outdoor Service Area (Sidewalk) license; and
WHEREAS, DSI received a letters from Macalester Groveland Community Council indicating they had no objection to waiving the 45-day waiting period in order to issue a Liquor Outdoor Service Area (Sidewalk) license; and
WHEREAS, the Department of Safety and Inspections received no other objections to the issuance of the license; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the license; now, therefore, be it,
RESOLVED, a Liquor Outdoor Service Area (Sidewalk) license is hereby granted with the following conditions to GMP Rochester LLC d/b/a Sweet Peas Public House (License ID #20160002119) for the premises located at 472 Snelling Avenue South in Saint Paul:
1. Since the building does not have a fire suppression system, the total number of customers and employees, in the building, may not at any time, exceed the posted limit of (99) ninety-nine occupants; per the MN State Building and Fire Codes.
2. Per City of Saint Paul Legislative Code 411.02, the definition of Entertainment A is “Amplified or nonamplified music and/or singing by performers without limitation as to number, and group singing participated in by patrons of the establishment” (includes karaoke). Entertainment A license does not allow for patron and/or performance dances.
3. Sidewalk seating approved for a maximum of sixteen (16) seats.
4. Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e. sidewalk) the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works. Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that failure to comply with this condition will result in adverse action being taken against all of their licenses.
5. License agrees to take appropriate action(s) to ensure that the sale, display, and/or consumption of alcoholic beverages is contained within the defined areas as per the approved sidewalk seating plan on file with the Department of Safety and Inspections (DSI).
